UM on a 150-pt admission scale gives 16 points to kids from lily-white Upper Peninsula, 4 points for children of overwhelmingly white alumni, 10 points for students who went to the state's "top" schools (who will be mostly white to be sure), 8 points for those who took a full state of AP classes in high schools (which classes are far less available in schools serving students of color), this is seen as perfectly fair, & not at all racially preferential

Sports scholarships and such do discriminate but they do not discriminate based on race which is illegal. Why can't merit be the one defining criteria for admissions? The answer is that the races are not equal and blacks and hispanics just can't compete. If the Supreme Court was going to overturn any AA bans it would have already done so. It has had plenty of opportunities: CA Prop 209 (1996), WA Initiative 200 (1998), FL "One Florida" plan (2000), and two Federal Courts (5th & 11th Circuit) ruling AA programs unconstitutional (1996). The US Supreme Court has refused to overturn the bans/rulings in every single case. And keep in mind, there are now two new Bush appointed Justices sitting on the bench. ;-)
