@papageoff Good point! I don't think the lawmakers thought this situation out very well. They have no reason not to allow a constantly pulsating brake light. They would mandate helmet use if they could, in the interest of saving lives, so why not flashing brake lights to save lives? The problem is in getting through to the right federal lawmaker who would not just disregard a request to modify the law.
The easy way around this is to install an auxilliary taillight, like an LED bar, and make it "flash". That way the OEM "stop lamp" is still steady burning.
wow, thanks for the information. I am still going to get a tail-modulator on all my bikes and loud-er exhaust until they do something to get those crazy drivers off their cell phones.
word to the wise: it is steady burning after it goes through the safety flash.

@tavery80 Unfortunately, that is illegal, too. The law states that all other lamps must be steady burning. This includes auxiliary lamps.
