Yes, you should use a cross walk when crossing the street, BUT, using his better judgement, the old guy looking in the direction the TRAFFIC SHOULD BE COMING FROM saw nothing, that's why he crossed, and got hit by a guy who had no buisiness on that street. Things like this is the whole purpose of one way roads.

As a San Francisco attorney, the cyclist was breaking the law by going against traffic. Jaywalking isn't breaking the law. It's a violation of city ordinance that rarely gets enforced.

It's lucky the pedestrian wasn't seriously hurt, because the cyclist was wrong. It isn't the case that mutual fault "cancels it out;" it just makes each party 50% liable for whatever damages result. If one party suffers no damage, and the other throws his back out, then the party who suffers no damage will be 50% responsible for the other party's back injury, and will have to pay compensation accordingly.
