  • i looked it up. its in the fifth amendment. this scammin con man isnt required to be a witness against himself. he isnt required to take the stand at all.

    He can't be required to be a witness against himself, but he can be required to take the stand and give his testimony as to what happened. He can also be required to answer any questions the lawyers ask as long as he isn't compelled to witness against himself.

  • No there aren't. The amendmends mean exactly what they say, nothing more and nothing less. Reading anything into the amendments is exactly like me rephrasing your sentence and saying that it means something else. It clearly means exactly what it says. Twisting and perverting the meaning of it, just as you're doing with the amendments, is disgusting, pathetic, and a lie.

  • Yeah, for the most part people should be allowed to carry firearms, although I'm in favor of them applying for licenses for background checks and such.

  • There was never any such protection. The rule (as established in the 5th Amendment) is protection against self incrimination. It doesn't say that the defendant doesn't have to take the stand because he could possibly incriminate himself. He's required to take the stand and answer any questions asked as long as he isn't required to incriminate himself.

  • ok professor. thanks for the history lesson. its obvious that you know some shit, or think you know some shit. i was just saying that if he was called to testify, he could refuse after asserting his fifth amendment rights. he obviously was a conman and any testimony he gave would have been incriminating.

  • So according to your logic, any person can refuse to take the stand. That's the logical conclusion to your reasoning, and it's also totally wrong. People are considered innocent until proven guilty. As far as the court is concerned, he's innocent and any question is fair game unless it is determined to incriminate himself. Then he wouldn't be required to answer it. He could if the wanted to though.

  • Yes they could have. And he would've been required to answer all the questions unless it was determined by the court that they violate the 5th Amendment's protection against self incrimination. The way he would've asserted his 5th Amendment rights would've been to petition the court to rule any questions that could be self incriminating as a violation of the 5th Amendment and not allowed in court. It's really not that hard to understand.
