This has already happened in Massachusetts. Catholic Charities closed their doors in 2006 because they couldnt refuse to place children with same-sex couples once gay marriage was legalized.
THE FACT IS a church doesn't have to marry a gay couple if they feel it contradicts their beliefs ONLY in states where same-sex marriage is not allowed. Right now, four activist judges on the California Supreme Court overturned California law (Prop 22) that defined marriage between one woman and one man. This makes churches who refuse to perform same-sex marriages in violation of the law and subject to legal action (law suits, losing tax-exempt status, etc.)

Prop 8 is hugely flawed. Most have a problem with the image of two men or women getting married. However, Prop 8 also affects those who are a male and female couple--except one spouse was born either Intersex or with the Harry Benjamin Syndrome (both neurological birth defects). Prop 8 WILL negatively affect both Homosexual & Heterosexual relationships and will be a hard burden on those born with birth defects. Don't take away the right for a person to freely love another. If Prop 8 is not passed heterosexual couples will still be able to marry so I don't see what this has to do with infringement of religious freedom (in your case I'm assuming you mean CHRISTIAN freedom). Keep in mind that not all religions condone two human beings loving each other depending on the physical traits they acquire. So can't I easily argue the same in support of opposing Proposition 8?

A yes vote on prop 8 will regulate a sacrament. Why don't we make giving communion to Baptists illegal? If a church chooses to allow the sacrament of marriage to homosexual couples, it is an infringement on religious freedom to deny them that.
I think that regardless of where you stand on same sex marriage, we need to consider the consequences that this will have to our voice as citizens. Undermining the constitution endangers people on both sides of the debate. I think there is a right and a wrong way to gain rights, and no group should be allowed to gain rights by taking them away from another group, or by trampling the constitution.
The current law also infringes on religious rights and violates the first amendment - it is unconstitutional and opens doors for more discrimination and penalties against religious groups practicing their faith in the name of tolerance. It is a dangerous road to go down. Since same sex marriage would be a creation of the state, unlike traditional marriage, the state would be obligated to protect it - putting them at odds with religious groups by the nature of the law.
One important distinction I think needs to be made is that Prop 8 does not give or take any rights away from same sex couples. The rights they are seeking are federal rights and will not change, regardless of the definition of marriage. They can and should seek the rights they are looking for at the federal level without changing the definition of marriage.

The point of the story of Adam and Eve is to explain the miracle of how we humans began. Adam and Eve had the right biology to procreate, and so they did. But do we punish man-woman couples today who do not procreate? Of course not.

The Bible condoned slavery. It approved a man having sex with another woman if he & his wife could not conceive a child. It condoned polygamy & the keeping of concubines (mistresses). It was written at a time when women were considered to be men's property. Do we agree with any of these ideas today? Of course not.

I feel like the situation has been spun by the opposition to have us believe that same-sex marriage is an infringement on their civil rights, but in reality, a yes vote on prop 8 will mean an infringement on religious freedoms (the freedom to practice our OWN religious beliefs) so for now i think it's important we protect this religious right we have to religious indifference in the face of the government.

What rights will Prop 8 take away? Through existing domestic partnership law, same-sex couples already have the same legal rights and privileges as married spouses (Family Code 297.5)
If the definition of marriage was just a social title, there wouldn't be an issue. However, since it is a legal designation, redefining marriage clashes with freedom of religion and opens the floodgates for churches to be sued for discrimination.

Yes on Prop 8 restores the traditional definition of marriage and thus protects religious freedom--the right of churches to believe that same-sex marriage is a sin and refuse to incorporate homosexuality into their doctrine or practices.
Prop 8 takes nothing away from same-sex couples who already have "the same rights, protections and benefits" as married spouses under California domestic partner law (Family Code 297.5)

If a church doesn't want to marry a couple because of their beliefs--THEY WILL HAVE TO, or possibly lose their tax exempt status. Additionally, ministers and other ecclesiastical leaders who believe same-sex marriages is sin may be sued for hate speech and risk government fines.

Another way legalized same-sex marriage impacts freedom of religion is that religious adoption agencies may be forced to place children with gay couples (even though there are many non-religious agency options available). This has already happened in Massachusetts. Catholic Charities closed their doors in 2006 because they couldnt refuse to place children with same-sex couples once gay marriage was legalized.

THE FACT IS a church doesn't have to marry a gay couple if they feel it contradicts their beliefs ONLY in states where same-sex marriage is not allowed. Right now, four activist judges on the California Supreme Court overturned California law (Prop 22) that defined marriage between one woman and one man. This makes churches who refuse to perform same-sex marriages in violation of the law and subject to legal action (law suits, losing tax-exempt status, etc.)

She is right on both points. The spin is that a no vote gives rights although domestic partners already have the same rights and beneifits of married couples, including the right to divorce. A no vote won't give them any more rights.
Her 2nd point-- One only needs to look at Massachusetts, where the courts ruled 4-3 like here on the matter, to see religious infrigements. Catholic Charities ended an adoption program over 100 years old because they then became required to adopt to gays, etc.

Prop 8 is hugely flawed. Most have a problem with the image of two men or women getting married. However, Prop 8 also affects those who are a male and female couple--except one spouse was born either Intersex or with the Harry Benjamin Syndrome (both neurological birth defects). Prop 8 WILL negatively affect both Homosexual & Heterosexual relationships and will be a hard burden on those born with birth defects. Don't take away the right for a person to freely love another. Marriage isn't about religion. Not everyone gets married in a church. People can get married by the justice of the peace. Let your church refuse to marry gay people, but church and state are supposed to be separate.

If Prop 8 is not passed heterosexual couples will still be able to marry so I don't see what this has to do with infringement of religious freedom (in your case I'm assuming you mean CHRISTIAN freedom). Keep in mind that not all religions condone two human beings loving each other depending on the physical traits they acquire. So can't I easily argue the same in support of opposing Proposition 8?

The unions that exist between a man and a woman in matrimony form the fundamental foundations for societies in creating families. When raising a family males and females together afford their children important influence in the way they nurture, the example the set forth and by the characteristics inherent in their gender. Having both a mother and a father is the most ideal situation for a child. I can not support any legislation that would impede the influence of a traditional family. Yes on 8

Voting NO on 8 won't impede tradition families. But voting yes on 8 will impede non-traditional families which exist and will continue to exist and to form no matter what. Vote NO on 8 to give ALL families the rights they deserve. Vote NO.

"Non-traditional" families that should be on prop 8 legislation:
1) Children raised by a single parent
2) Children not raised by their parents, i.e. grandparents, aunts, etc
3) Children adopted by surrogates of a different nationality
4) Children living in group foster care
cowboy, I agree with you about the value of tradition. any non-traditional family obviously cannot function in society. obviously.
let's keep the sanctity of traditional marriage, even though 60% of them end in divorce.

A yes vote on prop 8 will regulate a sacrament. Why don't we make giving communion to Baptists illegal? If a church chooses to allow the sacrament of marriage to homosexual couples, it is an infringement on religious freedom to deny them that.

I think that regardless of where you stand on same sex marriage, we need to consider the consequences that this will have to our voice as citizens. Undermining the constitution endangers people on both sides of the debate. I think there is a right and a wrong way to gain rights, and no group should be allowed to gain rights by taking them away from another group, or by trampling the constitution.

The current law also infringes on religious rights and violates the first amendment - it is unconstitutional and opens doors for more discrimination and penalties against religious groups practicing their faith in the name of tolerance. It is a dangerous road to go down. Since same sex marriage would be a creation of the state, unlike traditional marriage, the state would be obligated to protect it - putting them at odds with religious groups by the nature of the law.

One important distinction I think needs to be made is that Prop 8 does not give or take any rights away from same sex couples. The rights they are seeking are federal rights and will not change, regardless of the definition of marriage. They can and should seek the rights they are looking for at the federal level without changing the definition of marriage.

I don't hate gay people, but I don't agree with what they do. Voting yes on 8 would not be against gays, but no on 8 would be against religion. This would get rid of our religious freedom to not disrespect a gay person. Marriage would not exclude atheists. I would support no, but not at the cost of my beliefs. Gay people should be thankful they have the rights they do now. In Saudi Arabia, they would get the death penalty for having a same-sex relationship. Would you rather live there?

You talk about religious freedom in relation to proposition 8. That being said, if marriage is a religious experience between a man and a woman, under your label, wouldn't that mean that Athiest's should not be able to marry as well? Think about it.

but... for all the defenses that do make sense.... this does not..... as a no vote would not affect your marriage, or right to it. it would affect other things sure. but.. this in particular makes no sense.
