It was his friend. He had a right to feel strongly about it. And the police, in arresting an older Black man who walks with a cane, in his own home, ACTED STUPIDLY, like the man said.

THAT IS NOT A CRIME. When a cop hand-cuffs you, and you are not a suspect in the commission of a crime, YOUR CONSTITUTIONAL RIGHTS HAVE BEEN VIOLATED. That was as stupid thing for the cop to do, like the man said.
And it is perfectly legal to use your free speech rights to yell at a cop, and tell him that you do not approve of him violating your constitutional rights.

Yelling at him could be a crime, absolutely. If you are refusing to obey an officer while he is conducting an investigation. Or do you really not know that? And do you really not know that an officer is perfectly within his rights to cuff a person of interest(not yet arrested) if he feels that person's behavior is aggressive (verbally or physically) for the safety of both parties? No Constitutional rights were violated here. Did you really not know that?

Gates did not refuse to obey.
No one's safety was ever threatened. Least of all the police officer.
No law was broken. Except, perhaps by the cop.
Yelling, is a clear free speech issue, protected by the constitution.
Arresting a man, in his own home, for yelling at you, is a violation of his constitutional rights. If he took it to court, Gates would have a strong case.

Oh, and I think you may be interested in the words of the Black Sgt who was with the officer at the home. He wrote in an e-mail to CNN... The officer, Leon Lashley, said he "spoke the truth" about the arrest, and he said Gates should consider whether he "may have caused grave and potentially irreparable harm to the struggle for racial harmony."
I think he would have a more accurate take on the situation than you or I since he saw it all go down.

No one is doubting that the cop "spoke the truth." I never said he lied.
And Lashley is entitled to his opinion about the effect on "racial harmony" of Gates actions. I am not even saying Gates did the right thing. That, I dont know for sure. But what I DO KNOW IS, whatever he said, in his own home, IS PROTECTED BY THE CONSTITUTION.
And when he was arrested, his constitutional rights were violated. THERE IS NO QUESTION ABOUT THIS. Lawyers on Fox Snooze even admit this.

Of course accusing a cop of being a racist is not an arrestable offense. But refusing to cooperate with a cop who is simply investigating a situation is. If a cop came to my door investigating a call about a possible break-in I'd invite him in for coffee, give him whatever info he needs and thank him for taking the time to make sure my house and neighborhood are safe.
