I'm usually one to defend our police but the officer was totally wrong in this case. I hope he didn't take your phone off you and you had every right to film.
the problem what happened at brownhills nigel maby god rest his soul, passed on, and his negligent wife took over the running of his markets. i traded on tht market since i was a kid with my father. RIP brownhills.
Could you give me the precise time and location where this video was taken? The officer was talking BS - there isn't even a valid reason for claiming this to be taken in as evidence as it does not pertain to the materials they collected, nor would it stand up in court as anything useful (your comment "bring your own" was actually legally accurate). I want this officer identified and educated.
the police know nothing about photographers rights, although that doesn't stop them arresting you on terrorism charges for it. it's actually illegal for them to delete photos/videos you've taken and they can't stop you recording in a public place, but because they have a uniform they think you'll do whatever they tell you.
Im sure that if you called brownhills police station, and told them you wanted the annoying little twat bastard with no meat on him, to be educated, they would know roughly who you mean.
They'd at leats be able to narrow it down to the male half of the station.
Public property vs property ON crime scene. It is a big difference Flag... If you were on the streets then its a diff ball game. This is in N.A. at least I Assume you're in the UK...
Who's gone around minus-ing all the comments? xD All I said was I loved the way he said "bring your own phone" :D I posted the same on the boards, hope I didn't get torn apart for that.....
all i was trying to show was that i was perfectly compliant if he'd said yes please and not followed it up with a threat i'd have been happy.
what i was doing, filming in a public place is not illegal.
His threat to seize my phone as evidence of an incident (that happened earlier,) was a complete fabrication. It was evidence or it wasn't he just wanted me to stop filming. whether it contained evidence was not affected by what i was doing at the time. it was just bullying.
law abiding member of the public don't run around with cam or cam phone videoing what police are doing. They go out a video all the wrong doing's and use it to report the crime. But you would rather buy "Pirate DVDs", then whine when the police bust them.
so next time be a law abiding member of the public and report crimes as they happen.
notwithstanding that Knappa22 is correct in what he says, i was allowed to film and they were not allowed to take my phone because they had no legal reason.
listen to what he says, if you don't stop doing something i don't like i will seize your phone for some other random reason.
He is partly correct. You can film any situation but if requested to stop filming, or you refuse to comply with a request to hand the telephone over, you can be arrested and charged with obstruction.
I've had to deal with cases like this in the past and it can take a long time to get your property back without any laws being broken.
Is it not "without reasonable suspicion" of a crime in progress or having being committed the police are NOT allowed to take ANY property from you without a warrant. To do so would be ILLEGAL. Furthermore you are under no legal obligation to delete images/video or remove memory cards even when asked to do so by a police officer. You can only be arrested for obstruction if you are causing an obstruction (to the officers duties), filming without interfering with their duties is NOT obstruction.
unless you're obstructing them in which case it is illegal. They have every right to confiscate the recording equipment and it will be returned once they are satisfied you haven't done anything wrong.
Stpuid little pig bastard cant stop you filming.
Annoying little bastard !

i don't really want to give that level of information. i don't want to expose myself that much.
he was clearly making it as he went along and i think i out manoeuvred him a little, don't want to embarrass him anymore than i already have.

Bullying? You call him giving you a reason to stop bullying? What did you want him to do? give you a sweetie for being a good boy and stopping?

i expect him to treat a law abiding member of the public with respect and courtesy yes.

So the people who filmed police interceptors for example, are not law abiding subjects. You are allowed to film the police.
heathenwalking 2 years ago
The officer is wrong. You are allowed to film what you like in a situation like this.
If he had confiscated the phone without legal reason, it is deemed theft and you could prosecute him.
Knappa22 3 years ago 7
Not true. If they refuse to give it back without legal reason (and they can take as long as they like) then you can try and prosecute them.

a fabricated paragraph from an online web forum won't stand up in court I'm afraid unless you think a police officer cannot confiscate a computer ?

I'm I'm sure it's illegal if you start twatting them with the camera.
However, in the context of the clip, no obstruction or illegal act is being committed.
123WelshDan321 3 years ago
numpty lol what did you expect the police to say? 'oh please carry on videoing us at work so you can post it on youtube for brownie points'
