If they were soldiers fought at the battle, it was not a crime.
If they were surrendered POWs, it was a conventional war crime.
If they were civilians embroiled to the battle, it was the colateral damage.
If they were civilias killed intentionally , it would be a conventional war crime.
If millions civilians were killed in organized way as a scheme carried on, it would be a crime against humanity. But Japan had not such a scheme.

By "Documents of the Nanking Safety Zone" published in 1939,
population in Nanjing was 200,000 in December 1937 and 250,000 in January 1938.
