Dirkhising died accidentally during the commission of a sex crime by two pedophiles. Shepard was tortured and murdered not as part of the robbery, but as an afterthought to show the contempt of the criminals for gay people. The Dirkhising killers called 911; Shepard's killers just walked away.

The whole point of a hate crime is that it's an aggression towards the victim AND to the victim's community (gay, black, jewish, religious, whatever). In other words, a hate crime is intended to hurt the victim AND terrorize the victim's community. If a community is terrorized, society at large cannot prosper in peace. I was aware then (as I am now) that "god" is imaginary, but was told my admission I couldn't PROVE there is no "higher power" of any kind was sufficient.
I don't know of a case where saying "there is no god" resulted in expulsion from scouting, but it's possible.

I don't agree with its decision, and neither did the prospective scout leader who responded with a lawsuit that went all the way to the U.S. Supreme Court (see Boy Scouts of America v. Dale, 2000) where the highly controversial 5-4 decision went the Boy Scout's way.
I still think BS is overwhelmingly positive for most kids, but it's the 21st century!
