  • Thanks for pointing me in the direction of how I should use that phrase cause now it makes perfect sense to me that section 861 only covers several people who are taxed. And since everything points to section 861 for determining taxable income, I assume under inclusio unius est exclusio alterius income not mentioned is not taxed.     Actually, having debated this on here for YEARS I have a database of cases that prove any of your argument wrong. And yes, some income not mentioned specifically IS taxed, read Section 61.

Also, if you think I like the current regime, you are nuts. The facts are the facts, the income tax is imposed on every citizen and their income from anywhere in the world.   • LOL, since he responded so fast I'll write one last reply to Retired Squid, although he keeps using strawman court cases to try win the argument. Like I said, I still need to investigate this but its amazing me how vehemet and hardcore Squid is trying to convince me with illogical fallacies. I mean, he defies his own argument by saying that latin phrase is for figuring out the intent. So according to that phrase, the intent of Section 861 is to tax nonaliens and foreign income and nothing more.

  • @heffer84 Even a casual reading of section 861 and its regulations makes it clear that the statute and regulations were enacted to deal with the problems of calculating the taxable incomes of nonresident aliens, or for dealing with special provisions for taxpayers with incomes from sources outside of the United States. Section 861 is part of Subchapter N of the Internal Revenue Code, which is titled “Tax Based on Income From Sources Within or Without the United States.”

    More specifically, section 861 is in Part I of Subchapter N, and Part I is titled “Source Rules and Other General Rules Relating to Foreign Income.” The other parts of Subchapter N are titled “Nonresident Aliens and Foreign Corporations,” “Income from Sources Without the United States,” “Domestic International Sales Corporations,” and “International Boycott Determinations.” Are you beginning to see a pattern?

  • MasterPhil, you do realize that, in most cases, under Title 26 of the U.S.C. you must ALLOW your employer to send your withholding to the IRS right? In most cases the code does not allow for automatic withholding by employers - it is rather "opt-in". You would then become liable for withholding, determining your taxable income, and informing the fed gov't of it instead of having your employer do it. If the gov't doesn't know about it, they can't bill you for it, but they'll sure try.

    Only Chapter A matters for most people.

I find it interesting that the index to the Internal Revenue Code DOES NOT specify a "liability for income tax." Proof it's not in the index watch?v=B2AkTRQuSrQ

    Title 26 Section 1 provides the liability. As a Citizen all of your income from any source is taxable unless specifically exempted. The source (foreign/domestic) does not matter.

Keywords in Section 1 are "taxable income." Taxable income is defined in various sections of the IRC but it all circularly refers back to Section 861, which by law only imposes a tax on certain income. Under inclusio unius est exclusio alterius, anything not specifically mentioned mentioned is NOT TAXED; this is common law!

  • It's funny ya know! Like... the guys below me tells us to look at the IRS web site for the truth! Some people just don't get it. Do I file? Yup! But only because I don't owe the government any taxes, and I get the earned income credit, which means I get all the money back I "lent" to the government. If I owed taxes...I would not file. I do not meet the requirements to file, the rules for "Income from within or without the US." This series has educated me...and my friends and family.

  • Are you kidding? Taxable income is thoroughly defined in the tax law (and on the IRS Web site). There is wage income, interest and dividend income, capital gains, alimony, rental income, lottery winnings -- you get the idea. And there's a place for each and every one of them on your Form 1040 tax return.

    Sorry to be the one to break the bad news. Denial isn't your friend.

    There IS one major conspiracy by the Congress regarding taxes -- to keep workers paying BY FAR the highest tax rates. Those who actually work, those who actually operate the business, or are self employed, or work somewhow, are taxed 2-4 times as much as those who make money by credit sways, leverage buy outs, derivities, capital gains.

    Tax all income alike, make it simple.

  • never in my life have I seen, or heard something so defined in detail than this video set of 9 represented here. Granted the monotone voice was hard but, the direct evidence of education was overwhelming. No theories, opinions, ect... Just the Letter of the law. I wish religion was this easy!!!

  • One of the best eye opening videos ever. I am taxable, being a resident alien, but that does not stop me from wanting all the people of the united states to stand up for what is right and just. I wouldn't stop Ron Paul or the likes from repealing the 16th, but it really does seem unnecessary. I think it is in need of some serious clarity and to have some of the removed text replaced and 861-8 uncluttered. I think Ron Paul should watch this!
