Changes to it can only be made through amendments but politicians get around that by ignoring the constitution. It was a simple question that should have been asked long ago. @overshotfilms08 I don't understand what you're asking me about. Yes I'm serious, there is no question that the constitution gives congress authority to reform healthcare. Conservatives really have no arguments that make any sense. Because everything they object to, the "gross overreaches" by a democratic congress were first done by a Republican congress. @gkatta - Clearly there is a question about the authority of congress to reform healthcare. It is not included in the delegated powers of Congress in Article 1, Section 8, and only the broadest incorrect interpretation of the commerce clause would allow such reform. That interpretation would also allow congress to regulate health care in foreign countries. The clause was meant to stop states from enacting tariffs on goods from other states. It's not about race, it's about limited government.

So when I criticize people for not critiquing her policy and instead attacking external factors and you offer up some policy critique from a liberal perspective - it's not even a policy critique you have. It would suggest that you can't oppose the policy sensibly as a conservative, libertarian, freedom rider, whatever you call yourself.

@wincelet It makes no difference whether there was health insurance back then or not. The constitution enumerates the powers of the Federal govt. Changes to it can only be made through amendments but politicians get around that by ignoring the constitution. It was a simple question that should have been asked long ago. She should be able to defend the constitutionality of any legislation she backs because she took an oath to uphold the constitution.

Any reading of the constitution, even by the most disgusting conservative strict constructionist judge, wouldn't rule that healthcare lacks constitutional authority. He was asking the question just to frame it in a way as though there were some question to healthcare reform's authority - a question that there shouldn't be since the reform in question had an obvious basis in the law, and so she laughed

Conservatives really have no arguments that make any sense. Because everything they object to, the "gross overreaches" by a democratic congress were first done by a Republican congress. Republicans, teabaggers aren't worried about congress overstepping it's authority, just non-racists over stepping their authority.

@gkatta - Clearly there is a question about the authority of congress to reform healthcare. It is not included in the delegated powers of Congress in Article 1, Section 8, and only the broadest incorrect interpretation of the commerce clause would allow such reform. That interpretation would also allow congress to regulate health care in foreign countries. The clause was meant to stop states from enacting tariffs on goods from other states. It's not about race, it's about limited government.
