an arrest warrant does not warrant a house search....plus they have no exigent circumstance....the guy should have gone on his porch and denied entry...to search the house they need a search warrant... and exigent is only for the safety of someone or to save evidence.....this is illegal

If they have a warrant to arrest him they dont have a legal right to search the home unless the home is listed in the warrant. If he had said "no" you cant come in they are stuck arresting him. The personnel searching his home were walking around casually and didnt look like they knew what they were looking for. What is illegal about any of this? Police had an ARREST warrant. Therefore, the arrest was lawful. The police told the homeowners that they needed to "search" the home. At that time, the homeowners should have said a resounding HELL NO and never consented to any type of search without a warrant. The homeowners NEVER denied them consent and the silence is equal to consent. Next time, either do not open the door or if you know they have a warrant for you then be outside drinking a cold beer.

I am an ex corrections officer. I have several years in Para lawenforcement (Security Patrol ). The search is "incident to arrest". Actaully they were very nice about the ordeal. I am suprised that they did not enter with a T.R.T. team. (tacticle response team)..

If they have a warrant to arrest him they dont have a legal right to search the home unless the home is listed in the warrant. If he had said "no" you cant come in they are stuck arresting him. The personnel searching his home were walking around casually and didnt look like they knew what they were looking for. Any cop who has served a warrant knows that you have to list the areas you want to search otherwise the "fruits of the search" are tainted and inadmissible. It took the cops a long time

What is illegal about any of this? Police had an ARREST warrant. Therefore, the arrest was lawful. The police told the homeowners that they needed to "search" the home. At that time, the homeowners should have said a resounding HELL NO and never consented to any type of search without a warrant. The homeowners NEVER denied them consent and the silence is equal to consent. Next time, either do not open the door or if you know they have a warrant for you then be outside drinking a cold beer.

This was nothing more than retaliation by the Mass. Gestapo b/c Pechonis allegedly threatened a police officer on his website after the officer threatened to kill his son. No, they can go beyond the "wingspan" - that the automobile exception. Where police execute an arrest warrant in a dwelling, they can do a "protective sweep" - which allows them to do a brief search of "adjoining" rooms to ensure that there are no dangers to police safety. At that point, anything in plain view is fair game.

Just because he's in his own residence doesn't mean it's legal. Look up Mass General Law chapter 272 sec 99. They had a warrant, and if you think they didn't, warrants are public records anyone can research it. Just think about it, if the police entered the house said they had an arrest warrant, made the arrest and they didn't have one, all of those cops would be fired and sued for a civil rights violation.

He was arrest obviously for threats to commit a crime, all though he still thinks that there was no arrest warrant(warrants are public records, come up with another lie). I also believe that he is currently facing an illegal electronic survillance charge. The issue is two party consent, in which he obviously didn't have it. He did not need their consent. He was filming within his own private residence. They did not have a warrant to enter his home. If you notice, they shook his hand. This was an attempt to by-pass a warrant. As weak as it may be, they'll probably make a claim that the handshakes were permission of entry.. These cops broke the law... Paul may have also done so, but this video makes their case against him weaker.
