They have different melodies! Just because they have the same style and the same repetitive eh-eh-eh part doesn't mean that one's a copy of the other. If you decided plagiarism by those loose rules, then almost every song would be a copy. If you want plagiarism look to Be Happy by SNSD and Born This Way by Lady Gaga; they overlap each other. But since these two actually go well together, (GO WELL, not overlap), they're obviously not the same thing.
