They could easily be forced by Nintendo to discontinue progress on the mod (it's happened before on similar projects dedicated to other old video games), and it's up to Nintendo whether they want to do that or not.

I am a voice actor for this project. Last I heard the producers were in the middle of talks with Nintendo over producing this as a fan project. There have even been talks about producing this as a full-fledged commercial game, but we'll just have to wait and see....
