Judge Napolitano is no such thing. The justice system is not the Marine Corps; it's not, "once a judge, always a judge". He's a Fox News blowhard hack. It doesn't matter what he says, its enough that he peddles books and calls himself a judge on partisan television, to remove his credibility.

In my lifetime, the federal government (without respect to any party in executive power) has usurped the power of the sovereign states by ignoring it's own legal charter. How can a government rule a citizenry with any legal or moral authority when it ignores its own laws? The bigger question is "Why do we allow it?" Our government is no longer subject to any restricting laws, it is as arbitrary and immoral as any other oligarchical dictatorship, and soon to be just as violent.

And not to rag on him too much (I bought one of his books!), but I do have to wonder what kind of rulings he was responsible for while he served as a Superior Judge in New Jersey. It's not for nothing that New Jersey is jokingly referred to as "The People's Republic of New Jersey". It seems a safe bet that the Judge has basically ruined some lives during his tenure. It's part of the job description, so it doesn't make him exceptional in that regard... but it should temper our opinion of the man.

As much as one of "the men in black robes" can, Napolitano gets top marks. However, I think his trust in the Supreme Court as an interpreter of the Law is misplaced. Essentially, he asks us to trust the Federal government to interpret the actions of... the Federal government. The results, like Thomas Jefferson feared, have not been kind to liberty. One could say the whole idea is like trusting the fox to fairly and justly arbitrate any disputes with the chickens he oversees.
