Paraphrasing, they go by "Heaven and Hell" because Tony Iommi has said that they didn't want people to expect them to play "Paranoid" and "War Pigs" every night, or expect to see Ozzy. It's a way of getting around all the preconceived expectations that go along with the "Black Sabbath" name. Iommi owns the name though, so if they wanted to use it...they could. Ozzy and $haron have no say in it.
It has nothing to do with Ozzy. Tony Iommi owns the name and he could use it if he wanted. He's said several times why he chose not to...and I don't feel I really need to rehash them again. There's no legal reasons why he couldn't though.
Keep in mind the three new songs from "The Dio Years" were done under the Sabbath name...obviously without Ozzy.
The Heaven and Hell MySpace age has a song in their jukebox labled "Time Machine". Its double the tempo, but obviously a different song. I believe it to be a mixup - Anyone KNOW the real name of this song?
'Ear In the Wall' was only played the very first night and then was dropped. I grabbed the lossless copy of the show not 24 hrs after they played (which was when I originally posted this track). I'll post that song here tomorrow and if you want I can send you the whole show sometime after Xmas. Just remind me in about a week because I might forget.
This song was kick ass in Dallas. along with the rest of the set, but this one really stood out because the sound people really turned up the volume of everything and it stayed that way through the rest of the show. I can't wait for the new studio album.

Nothing off the new album that's going to be out in early '09. I read somewhere they supposedly had at least 8 new songs written already.
They played "Ear in the Wall" opening night, and the following night they didn't play it. They also played "Neon Knights" the second night, which wasn't played opening night.
It's just unbelievable that RJD is 67 years old! I can't fathom the idea of anyone else coming close. We need an album of new songs for this to continue, otherwise we'll still be holding out to hear Country Girl and Wishing Well when it's time for OZZY and Bill to come back.
They didn't play it opening night. They did have a drum solo though, and people have already been saying they'd perfer to hear Neon Knights instead of a drum solo.
At age 67 Dio sounded amazing and Heaven and Hell stole the show. I highly recommend seeing the show. Get there early for Testament. You don't want to miss their 6 song set.

The song on the Myspace page is "TV Crimes", rather than "Time Machine". It's the 3rd track on Dehumanizer. They messed up.
