Avicii actually had approval from Penguin Cafe Orchestra and Simon Jeffes, who wrote the song, to sample melody for his "Penguin" single. Therefor, no legality issues.

Leona Lewis and her management, on the other hand, never had any approval with Avicii and his management to sample his version. Hence, the plagarism / stealing / etc.
