Before they passed the law, Romney had the power to appoint a Senate replacement for the rest of the of the departing Senator just like other states do without an election.

The law they passed then ensured that there will be an election.

Kirk is an interim appointment, election will still take place in January and yes a law was also passed for this interim appointment.
