While Palestinians have in their lot, those who flagrantly defy any sort of stance on peace by provoking and outright committing violent acts, I would excuse this mentality. It's a small point to hold them to the fire for it; the defeated victim will tend to assiduously seek maximal profit from it's small advantages.

In practice, these penalties for the most part don't happen because of different factors such as when Muslims live in a secular state or other reasons such as living in a Muslim state where there is a tyrannical ruler, who may abuse this power. Just as the US constitution is subject to interpretation by const. lawyers so is the Shari'a.
