Amendment 10 distinguishes the difference between states and people: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
Article V, which describes the process whereby the Constitution may be amended states:
"...and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate."
