I dunno, one of the few times I've disagreed with her. The woman was selfish she made them go through the sale and loading the product in her car even though she was pretty sure she could find a better deal, but she used the guy as a backup just in case because she said she had the installer lined up. Plus the guy had it posted. The talk at the end about the "little guy" he is the little guy I bet she went to Lowe's or Home Depot where she should have gone in the first place. All about the money
What a bullshit ruling. She used too much emotion in concerns of her judgement. She holds people to contracts they at times dont read, so why not this woman? It just depends on how she can twist the law for her idea of justice. Sometimes she cant, but when she can.... it turns out like this.
Disagree with the judge on this. It was on the sign and it was obvious that there was a 15% restocking fee. Not the guy's fault if she didn't read the sign.
That is why the small busness goes out of busness. Why did this customer just shop around first! She brings the flooring back a week later and he has ordered replacment for his stock. The store is screwed. Sitting on stock is a gamble. It might take 6 months to sell. Store loses. He had to get a loan from the bank to keep the inventory now he has it back. She should start her own small busness and see the other side. Even the judge can not understand how much it cost to stay in busness.
wow, even in her closing statement in the hall she says we as consumers ignore the ..fees or fine print or whathaveyou. she ADMITS that she ignores them but signed the damn paper anyways. HOW ABOUT YOU TAKE some responsibility for what you sign. Dumbasses signing shit without reading the fins print. its called LIFE. deal with it. you're bitching about the fine print, you are not going to win, our government revolves around fine print and people not reading shit(patriot act of 2001)never read.

@Nicasitojoe I agree with you completely. I have seen several times "Refunds subject to 15% restocking fee" . That doesn't take up that much space on the keypad. Actually what he has takes up more space. I wouldn't sign anything saying that I read his store policy if I didn't.
@scottfwtx small claims court is rarely ever about the money, it's about the principal. Suing for $80.00 seems trivial, yes, but what shes really after is justification. For him to know that he was wrong and she was right.
I was a bookkeeper for a flooring store, they were very dishonest.... for instance they'd look at the car you drive up in and rate the mark up fee accordingly! but I do know if they have to order special and you cancel the order they themselves have a restocking fee, usually 20%
I have to say I disagree with the judge here. She clearly signed the paper stating she had read the policy. Yes, it was in fine print, but so in most contracts, yet they are still leglly binding. Claiming she was too stupid to read the contract before signing it shouldn't mean she gets her money back. Be responsible for your own action, the shopkeeper can't read the whole thing out loud to every customer. Its the customers job to find out what the policy is.
Milian has made quite a few stupid judgements but this one I had to voice my opinion about. She signed and agreed to store policy. It stated in his store policy there was a re-stocking fee.It was her fault she didn't read the store policy. It's something you check before you buy something. Milian has just ruled that you can sign anything and if you're ignorant you can break a contract. Truly shocking. Milian judgement FAIL
Don't waste the store's time. Price shop BEFORE you buy. Companies lose mass quanities of money from consumers that decide to cheat the system. There is nothing wrong with this restocking fee, she had every intention of looking elsewhere for cheaper material, why should the owner pay to put the stuff back, get the credits back in order, adjust inventory, and everything else involved, just because she was sure she could bring it back on a whim? How many people take advantage of wal-mart? ALOT
Its America your are free to cheat people, thats why America will give exemption from taxation to a cult called scientology. Sure America is great when it comes to freedom LOL
I have a feeling that this one felt good to JM...getting back at every jerky merchant who tried to or did charge a restocking fee! it is rediculous! 15%!!! She'd not save ANY money that way would she?
Best Buy also does this! it is why i won't buy any electronics from their store. My kids bought me a camera for my birthday, i wanted something smaller, so went in and looked to exchange it....they were going to charge me 14%.... i spoke with the manager and didn't have to because of the circumstances, but still.... i don't think a store should be able to do this with all items! computers, i can kind of see with how they lose value quickly. maybe... it is a rip off regardless!
Circuit City tried to pull this on me when I bought something that was defective out of the box. Guess it's not a surprise they aren't in business any more...
this guy is talking about wasting his time. How about avoid court for $80 and save your time. Geesh!!! How much money is he losing by even showing up. just give her her money back
@floydma Actually you're right, however, he made more money by showing up in the court. Both parties get paid by the producer of the show, and that's what it's called "Appearance Fee" plus that all of their expenses are paid to come to court as well including their hotel and food. No one can lose or win in a court show. Everyone wins for the sake of pleasing the producer and allow him or her to make money from the show!

@behvac If the store owner is THAT concerned with turning a profit, then he shouldn't even make returns an option.

Another cheap customer who thinks everybody else has to work for free!
I would recommend to the store to put it the restocking policy right below the credit card receipt signature line.
That's legally binding.
