  • markybasker: the constitution says nothing about "provide" the general welfare; it says "PROMOTE" the general welfare. There is a huge difference. Look it up in the dictionary.

  • The problem with calling something unconstitutional is that several people have different interpretations of the constitution. Specifically when it comes to the provide for the general Welfare of the United States of America

  • There are several things, Social Security, Medicare, which have been justified by this. If you look up the word, Welfare in the dictionary you will find, (the good fortune, health, happiness, prosperity, etc., of a person, group, or organization; well-being: to look after a child's welfare; the physical or moral welfare of society.)

  • So how can you expect to succeed, and why does the JBS even bother in fighting an argument which has already failed so many times before? I think it's better to argue that the services rendered by the government will be so subpar, as we see in other countries, that it will literally be a bane to the American people.

    I am against government run health care.

  • Markybasker, after I watched the video, I can see how you might think that calling this bill unconstitutional is loser and not a winner. The trouble is this buffon in the video does not mention the very thing that is unconstitutional and will get most of it stopped. The American people are free and sovereign. The American people are not owned by the gov and they and we are not slaves to the gov. The American people can not be ordered by the gov to buy something againt their will

  • The general welfare clause is tempered by the enumerated powers doctrine. If you take the liberal view of that clause, the government has no limitations so long as it claims it is helping people.

  • James Madison explained this in the Federalist papers. The JBS takes the words from our founding fathers, you know, the ones who wrote those words as what the Constitution meant. Read the Federalist Papers and you will understand that our government is twisting what the meaning of the preamble of the Constitution.

  • THANKS, AMERICA'S FREEDOM FIGHTER! Indeed, it is disturbing to know every single elected representatives on BOTH sides of the aisle swore to uphold the constitution, yet turn around and introduce pieces of legislation defiling that oath. We only need a part-time legislature to carry out the enumerated powers within the constitution. Leave the rest to be handled with the 10th Amendment, and leave us alone!

  • It's because the republicans are just as corrupt as the democrats. The real powers own most of the legislative branch as well as the executive branch. We need to vote all of these pieces of trash out of office! Plain and simple!

  • I was ready to say this is all predicated on there being some noticeable difference in Republicans and Democrats, there once was, many years ago... but you said it very well, and I simply second your motion that the trash is in dire need of being disposed of..... how did we get soo far from the path?

  • I don't know, but here's something interesting. It used to be that senators and congressman were chosen by our state legislatures. The 17th amendment allowed for our national legislature to be selected by popular vote. What's interesting is that this was passed the same year that the federal reserve was created. Perhaps its easier for them to corrupt this process they way they have with presidential elections.

  • The reason all government provided health care is unconstitutional is because article 1 section 8 enumerates to power to runs programs to the federal government. Further the 10th admendment gives unenumerated power to the states. A state may be able to legally under its state constitution have a statewide universal coverage, but there is no question the feds have no such power. Ur right that buisness isnt in the constitution either so fed takeovers of GM, AIG or citi are also unconstitutional.
