  • This is a bad rep for Carfax now, they didn't have a clue that a vehicle was SUBMERGED....

  • I bought an 06 Mustang and I couldn't make more than 20 miles from the dealership! The car broke down on the highway with no electricity, with a flat tire and no spare! in Other word, the car wasn't checked for safety before I left.

    They don't take the car back.

    I haven't paid anything yet, cancelled the payment and took out all my money. What is going to happen to me?

    this happened 3 days ago. I don't have a social security number btw, does it help?

  • Unfortunately, this happens a lot, where the car breaks down just after you buy it. But you can end up in trouble if you cancel the payment and keep the car. It's a good idea to get legal advice about how to handle this properly and protect yourself. The National Association of Consumer Advocates has info on their website about how to find an experienced auto fraud attorney who may be willing to help you get this straightened out. Best wishes with getting this resolved.

  • He should have some lemons painted all over the car. Have it neatly lettered in large letters telling everyone where he bought it . Park it close to the dealer, drive around near the dealer. People will ask him about it and then he can tell them. Don't say anything negative on the car. I bet in a few weeks thet will be more than happy to buy it back!

  • Sun Toyota in New Port Richey is just about as bad they sold me a extended warranty for $1200.00 and when it came time to horner it in the fine print there was a 40k mile clause and it had 41k when I bought it.

  • I got a car from Dubois Motors in Groveland Florida. It was a turquoise-ish Galant ES from 2003. According to car fax (after we purchased it), it has been totaled three times, and in serious accidents 8 times. They didn't warn us of this, and even let us see a carfax paper that has been edited.

If they won't give you a refund, you can consult an attorney who specializes in auto fraud cases there in FL and at least find out what your rights are. Many dealers traffic in rebuilt wrecks, and they'll keep getting away with it unless folks like you stand up to them. Time to go to battle stations! The National Association of Consumer Advocates has a website for finding pro-consumer legal help. Best wishes for getting a much safer car. :-)

  • That is FRAUD and YOU should Report them to your Local DMV (Department of Motor Vehicles) ASAP, although it's been 6 Months ago when we as Dealer's Sell Pre Owned they have to be Safety and Smog Checked there are Guidlines to this and your DMV

  • @Xboxlivemgear Yes the DMV FRAUD Division is Very Very Harsh, I work at a Large Dealer (Toyota) my Son went out without telling me then bought a Murano at what I call the mom an pop Lots Sled Lots, well the Dude won't fix stuff and then to Top it Off he had it advertised on the Web for $10950.00 and Sold it to him for $11950.00 and add GAP Insurance but didn't give him the Paperwork for it so basically he just swallowed it making an extra Profit of $1500.00!

  • 4 years today 02/16/2007. Arbitration and the Courts failed. No access to justice. Mossy Toyota still refuses to do the right thing insisting on sticking me with an unsafe and unusable rusted out flood car.

    I'd get some yellow paint to paint like a lemon write a few chosen words on the side of the car! I bought this car here & I'm still walking.

    It takes backbone I think the guys got it ,he just needs to get MAD enough.

    Burn me for 1000's for dollars see I'd be at that stealer ship plus drive that car where ever I could.

  • Buyer beware......what he did wrong was not having it checked out before he signed the contract. I bought a car from a used car dealership, but I insisted that my (reputable) garage inspect it first (at my expense). That way, I knew if it was worth buying or not. The 75 bucks I spent was well worth the peace of mind it gave me. And yes, I bought it, at $800 under Blue Book value

  • It's wrong to blame the car buyer, who should be able to rely on what a licensed dealer says about the condition of the car. But you're right that the smartest thing to do is to insist on getting your own inspection BEFORE you agree to anything. That's because dealers often lie. However, not having it inspected beforehand does NOT excuse the dealer from being obligated to tell the truth.

    Better yet, don't buy from a dealer at all. Why pay extra and still get ripped off?

  • @carconsumers They do lie. The dealer I bought my car from sold it to me with two tyres with skid marks down to the wire, a bad battery, no jack or tools. Then they didn't fix the door properly either. I got a mechanical check done before I bought it. I got another mechanical check after I bought it. The guy also was like "Oh my man out the back will take care of the cambelt." He then wrote "cam belt check" on the conditions of sale. Car dealers are sharks.

  • @carconsumers why would they lie and rip people off? that's like the dumbest thing they can do, now everyone knows not to trust that dealership again. any business that rips people off and is dishonest will be on my blacklist permanently.

  • ok lets keep one thing in mind here EVERY car rattles but that does NOT give you the right to call Ford the problem. its toyotas fault for buying the car and their fault for selling it. but the buyer is in deep crap if he bought the car, i purchased a Crown Victoria and the day after i bought it the power ignition coils all went out. that was a $1,200 repair and had the dealer not wanted my next car a toyota they could would and should have said "sorry we cant help you."

  • As a mechanic of 7 years the common things to look for would be to check the balancing shaft and also motor mounts haha that will take up the issue of the nightmare vibrator lol

  • my guess is that the vibration is caused from one of the cylinder not firing, which was probably damaged from the car being submerged? LOL

  • Car was inspected by a leading industry expert with decades of investigative experience and deemed it was once submerged. You can see additional information at mossyscrewedme com. The car was only driven about a month then stored. It has been registered non- operable and has not been used since.

  • Today is 1,380 days or 3 years, 9 months, 11 days since Mossy Toyota sold me a previously submerged flood car and refuses to do anything about it. Never buy a car from a dealer that needs to hide behind an arbitration clause!

  • Here's the deal: the payments were over $146 per month, and the total sales price, including a service contract and other add-ons, was over $10,683. Jon has paid all that in full, while the car has been sitting unused for years-- because it was unsafe to drive.

  • @carconsumers Why would you take delivery of a car that is shaking like that? Why bother with the test drive at all if you are going to just dismiss the problems?

    At age 18 I went to look at a truck, drove it, and swore I heard/felt something odd with the engine. I really wanted the truck, but knew better. How is this guy that oblivious to take delivery of a car that clearly had problems? Let them try to fix it then test drive it again. Due diligence was not taken by consumer.

  • It is definitely BS that they screwed the guy, but I couldn't help but LOL when I paused it at 3:03 to see the monthly payment of $55.XX... just take it to the scrap yard and chock it up as a lesson learned if that's all the payment is each month...

  • I had 2 Ford Escorts from the 90's I bought both new and they both shook and vibrated like crazy. The Ford Dealer just put their hands up in the air and did nothing for me either. Sorry you are having so much trouble.

    Yes, like millions of other car buyers, he bought a used car from a dealer he thought was reputable -- only to find that once he signed, it became an absolute nightmare. The car had been traded in by another consumer.

  • Mossy is HORRIBLE! I bought from them. I have caught them charging me for work they never completed on more than one occasion. The first time was a minor oil change, the second it was electrical sensors that made my car completely shut down while I was driving. Also, they will delete service records, so if you try to lodge a complaint against them and prove their wrongdoing, you had BETTER make sure that you have kept EVERYTHING!! Trust me, I had it happen. I will NEVER buy from them AGAIN.

    Today the Superior Court Judge rejected Mossy's motion to dismiss and offered no other resolve. No day in court, no arbitration, no nothing.

  • @lollopandgoran Yes -- Jon's attorney was talking about how the arbitration process is rigged against consumers. It's a trap. Even if the dealer violates the law, you get stuck without being able to defend yourself in court and have the law applied.

  • @kadihummer Jon's attorney' has been doing everything he can to try to get him a fair hearing, but -- his hands are tied by the forced arbitration. Meanwhile, Jon has had the car in storage for years, since he learned that it's unsafe to drive. Doesn't want to risk hurting somebody.

It's an absurd thought to me to get a carfax from a used car dealership. They could just redact any part of the document with a common word processor or image editor.

  • my sisters friend has the same car and it does the same thing. when driving its feels and drives nice but when stopped it starts to shake uncontrollably. i think it may be a car defect but if the experts say it has been underwater and thats the cause well then go with that cause im no expert!

  • Wow, Mossy must be a Nationwide chain. They had a Mossy Oldsmobile for years in the Houston area.

    The more national a car showroom is, the chances you will get less service. Pure and simple, each showroom is in competition with the next and returns hurt their bottom lines.

  • The dealer had Auto Check in the car... That was clean. After the fact I got Carfax, that only showed a rear end accident and not flood damage. That Carfax policy wouldn't have applied.

  • No clue... It purrs like a kitten in neutral or when it was being driven. Only at a stop sign or signal in gear does it do that. I don't know much about cars so I don't know the exact cause.

  • Clarification -- The dealer sold the car to Jon Perz for about $8000 plus he got an extended service contract and financing, etc for a total of about $12,000. Which he has now paid in full, in order to preserve his good credit.

    Historical footnote --

    Dealers got themselves a special exemption from arbitration, from Congress. They promised in writing then that they wouldn't oppose restoring the same Constitutional rights to consumers. But -- surprise! They lied.

  • The dealer sold the car to Jon Perz for $12,000. Hardly the price anyone would expect to pay for a junker. But -- as the expert who inspected it found, it's so unsafe he hardly even got to drive it. He did the responsible thing by storing it and keeping it off the road -- and keeping someone else from getting stuck with it.

    Unfortunately, Carfax's database is full of holes and many car buyers are lulled into a false sense of security when the dealer tells them the "Carfax was clean."

  • @TheGreatBender Yes, that's what they claim -- but -- many consumers are very disillusioned with Carfax. Its data is full of holes. And the "guarantee" has a lot of loopholes. There's an informative report posted at Consumer Affairs.com that sheds light on how Carfax really operates. Look on their site for "Carfax: Not Always All the Facts" by Lisa Wade McCormick.

  • Just because the car has some rust does not mean it was in a flood. If it had been a flood vehicle it would not have a clean car fax. It just looks like a vehicle that may have come from a northern state where they get moisture, that is normal rust. I did not wee any reference to what was wrong with the vehicle.

  • should have bought a new one I guess or perhaps an extended warranty or maybe read the contracts before signing them or agree to pay much higher prices to cover frivolous lawsuits because you can't take care of yourself like an adult. you have several choices that are not mentioned in this piece. hmmmm big bad car dealer against poor little old me. haven't heard that one before.

  • Why would you buy a car that rattles to begin with? You don't need a salesman to tell you.. that's a pretty big deal.

  • Even if I wad aware of all the fine print in the 10,000 or more contract and even knew what the hell mandatory arbitration was and the specified arbitration called AAA and NAF. No consumer would suspect they are in the pocket of the business. The consumer win/loss statistics are alarming. In fact NAF got busted for hearing arbitration cases, siding with the business then owning and running the collection agency. Collusion. They no longer take many consumer cases.

  • Never needed a cooling off period. In fact my spouse returned 3 days later to sign the title of my trade in. All I wanted was the "idler" adjusted. That never happened.

  • I am not advocating dishonest salespeople, but if you're going to make a big purchase and you don't educate yourself on it and read the fine print, it's your fault. No matter how many regulations are created to "manage" and "prevent" bad things from happening, there will ALWAYS be a way for you to get screwed if you go through every major purchase deaf, dumb, and blind.

    Take it to an independent mechanic before you buy. Read the fine print before you buy. It's that simple.

But since this guy bought a car that "shook raddled and rolled" on the test drive, he prolly paid an outrageous fee for it.     A snob and biased. Ford has exceded Toyota/Honda in quality. But old perceptions die hard. Even back in the 90s the Escort was a tough little car, lasting 150K, 200K, 300k miles. Nothing fancy or pretentious....it got the job done.

    Can we stay on topic? The same dealership wanted to soak Jon for $6000 on repairs for his Toyota T100 (that also had a broken tie-rod recall.....that Toyota dragged their feet on).

    Actually, no. In Edmunds it gets good used car owner reviews. 7.8 (out of 10) for a 1999 ZX2. When a car is submerged in water it should be totaled. There are too many electrical and mechanical problems that can result. Any dealer, after Katrina, was aware of flood damaged cars making the rounds all across the country.

    The problem isn't the car's design or age or any inherent problem, it's the dealership that sold a damaged vehicle.

  • Mandatory arbitration clauses allow for dealers to get away with this nonsense. This was not some corner lot no name dealer but part of Mossy Automotive Group. Over a dozen dealerships in several states. They were my go to for service for many years. Shame on these folks. The Aribitration Fairness Act HR 1020 is in committee and with it's passage creeps like this won't be getting away with murder anymore. I hope my story can help.

    I'm the unfortunate consumer...while I have never assumed the dealership knowingly "pawned stared" this flood car off on me, they failed as a prominent and upstanding business as portrayed on television and the outstanding service provided to me over the course of years. They failed at what was promised promised at the sale. They FAILED after discovery. Why? Because they do do not have to care whatsoever when there is a mandatory arbitration clause. TURN AND BURN I'm sure!

    It has been a long time since I have smelled a car to determine if it is Kosher or not. And as we have learned over the past several years, sometimes corporations are not all that honest. Why are you so angry? Are you affiliated with a car dealership? No...I'm sure you are just a concerned citizen. Then again...I doubt that very much. Perch and rotate!

  • I had the exact same situation happen where they refused to fix something about the car that was obviously covered up during inspection, and they assured me not to take it to my mechanic. After paying 2000+ for insurance and warranty, surprisingly nothing that was wrong was covered. They have terrible business practices,

Sharing my story with others and in addition drawing attention to the Arbitration Fairness Act HR: 1020 that needs to be passed so other consumers do not get the shaft from business practices like these.

  • Mossy Toyota had three choices if they actually cared about customer satisfaction:

    1) Fix the "idler" or vibration as promised (discovery of it being a flood car and previously rear ended would have remained unknown).

    2) Exchange the vehicle for another at no additional charge.

    3) Refund my money and take the car back.

    They chose to do none of those and not give me the time of day. Even after their discovery of it being a flood car they still did nothing and demanded arbitration to this day.

  • Having bought my last new car at Mossy Nissan, I found this interesting. I guess they just don't mind losing the business. I won't buy there again. I hope they spent Jon's money wisely...They will surely lose much more than they made.
