@ touristmap while I can understand a musician wanted to receive credit for his/her work I believe you're missing the deeper point. Once a song has been made/performed it is already and forever in the 'public domain' ... It is out there. Of course musician will want to protect there 'property' ... @Cancyrus Umm... I'm pretty sure anyone in the music BUSINESS is in it to get paid. Otherwise they'd be in the music CLUB or hobby-group. The 'deeper point' is certainly not lost on me, but I'm afraid you're mistaken about the 'public domain'. Just because I park my car in a public lot doesn't mean I should let someone drive off with it. That's why we have licence plates and registration. I think the car analogy is useful here, especially if you are gifted enough to have built your own car...
@touristmap -- I cannot unhear it, regardless of whether I want to. It is like an idea. And while you can certainly patend the design of a car, you cannot expect to own the idea. -Imagine if the first person to make a 'horseless carriage' had said "that's my idea, no one else can have one" ... and as to your business comment, I would say that's a matter of opnion and you are entitled to your own. I'm just glad most of the artists I enjoy don't agree with you.
@Cancyrus If most of the 'artists you enjoy' are feeding themselves and supporting their tour schedule with the money they're making from their music, then I'm not sure my point is a 'matter of opinion'. The reason you have their MP3,CD or whatever, boils down to.... money! If your music can be bought - it's for money! Business, on nearly every level, is a commercial enterprise. If there was no money to be made, than you would only hear music made by very rich people with time to burn.
@touristmap most of the artist I enjoy make their money from touring (taking a share of tickets sales from their amazing performances), merchandising (from shirts, stickers and - yes, even advertising), or albums -and this is important- that they sell at a show. Most major label artists net less than $0.25 per albums sold through traditional sales. If I want a CD, I buy it at a show. ... And no, I'm sorry but music is only about the money for some people. Most artists just want to be heard.
@Cancyrus I really don't know how you can separate ticket sales, merch, and album sales from the 'music business' hypernym. They are all part of the business and they are all MONEY-MAKING. Once again, it takes a lot of money for you, yes you, to hear the music you like. Believe it or not, but at least be less idealistic. Working musicians do just that - work - and if people just shoplift your product and remix it, I still say it's not a fair trade.
@touristmap look, friend - you have legitimate points but as everyone knows the music business is currently in the midst of a revolution. Things are changing because the old paradigm simply will not work in the new 'digital' age. I would like to continue this discussion but I find it increasingly difficult to phrase my arguments in 500 characters or less. If you would like, I would would be happy to reply to any further correspondence through my gmail account which has the same username.
@Cancyrus Ha! I know what you mean. 500 characters is a challenge. Maybe I'll drop you a line after we see a bit more of where this 'revolution' is taking us. I'm a musician / producer just starting out and take all this stuff a bit too personally perhaps. Also, I have the added perspective of being both a long-time listener / consumer of music as well as a composer / producer of it. I plan on making music artifact-based again (as opposed to this disposable MP3 rubbish) -- a counter-revolution?
@touristmap the offer stands - I think the main purpose of this movie (while decidedly supporting one side of this debate) was mainly to draw this discussion into the public forum. Instead of letting everything be decided by a few rich, powerful (& biased) corporations & government officials - we should be the ones who decide how art is used because 'we' make it. (&btw, I dabble in music as well, so I know how much time & money is takes - I just doubt I have paid for the same education as you.)
@touristmap The car analogy is useful - in that I agree with you're point that someone else should not be able to 'claim' what is yours, whether you built or bought it (which some musicians do when they purchase song rights from the original artist in order to cover them) However, the analogy is not perfect in that a car is physical property and a song (or any sound) is essentially a tonal vibration. Once I, or anyone else, hears it - it is 'ours' ... that is, it is now in MY head. --
@Cancyrus Did you know light travels in waves also? With your kind of logic, that would mean everything you look at belongs to you. Wouldn't that be an amazing scenario? Unfortunately, that's just silly. Everything you've been arguing really just brings me back to my original comment and concern: that this movie seriously discourages me from pursuing any career related to music production. If you had any idea how much it costs (time/money / LIFE) to produce music, I don't think you'd say that..
@touristmap yes, visual media is included in my arguement... if you watch the movie you will see that that is addressed. 'Bootlegging' is not what I am advocating - no one should be able to resell something that is not theirs as there own. So the person who has the owns Davinci's 'Mona Lisa' or Van Gogh's 'Starry Night' shouldn't have to worry someone conterfieting it - but now that the image is "out there," it has been replicated, emulated and incorporated in other works of art.
@Cancyrus I own the movie. I went out and actually BOUGHT a hardcopy. There is NO DIFFERENCE between 'sampling' and 'bootlegging'. Again, referring back to my very first comment, I have no problem with people emulating (which is the same as 'covering') a song. I also have absolutely no problem with being inspired by a work of art enough to make your own version. But sampling is like taking the original 'Starry Night', cutting it up, and presenting it as your own piece of art, and that is B.S.
I have a problem with 'sampling': It IS stealing. Some (not all) of the arguments in this movie seriously discourage me from pursuing any career related to music-making. If you want to be TRULY creative: learn an instrument, start a band, record yourself...
AND THEN remix yourself! Girltalk, etc. are like ventriloquists who need to try sticking their hand up their own asses if they think they deserve to get paid for cutting and pasting other people's work. COVER the song, don't sample it!!!
@touristmap GT's albums are (essentially) free. You pay what you want. he gets paid to DJ just like any other DJ and hes great at doing that. If it werent for bands like Crystal Castles remixing Health's "Crimewaves" nobody would even know who Health was. Remixing/mashing up in and of its self is an amazing tool and a way to refresh something that otherwise might have lost relevance. Remixing your own songs is pretentious. You obviously dont understand the premise of this entire concept.
@thelocal711 I didn't mean 'remix your own song'. I meant 'cover an existing song, and then remix that cover.' I don't see what is pretentious about that. Of course I understand the premise of the concept. It's just that it is a slippery slope. GirlTalk's albums may be 'essentally' free - but THAT is the problem. A LOT of hard work and time goes into recording, mixing and mastering the samples he uses (I know), and to give them away for free is wrong. Would you like working for free??
@crapola1234567 napster has an important place in the history of copyright law. the film is using napster to convey the issue at hand, that we're becoming a more "remix" culture (look at GirlTalk). it's just one of the examples the film is using to prove a greater point. it's actually really informative.
@nfb its probably from "in rainbows". they promoted remixing by putting samples and such on their in rainbows cd so people could remix it.. radiohead OWNS! :)
@PKcarnage I know you asked this a while ago, but if you're still wondering what that flip of Videotape is, it's by Amplive. It's called 'Video Tapez' and features Del The Funky Homosapien. watch?v=vhdak6YGxqA
This just aired in Australia tonight 5th January 2010. I loved it but how come no-one is talking about the medical ideas that are strangled through patents and possibly inhibit forward process??? Cure a f&%##@ disease you greedy bastards!!!!
I know, right? I saw it on foxtel too. And you're right about medicine. TRILLIONS of dollars into research and the same diseases are sound since my dad was a kid.
Cancer, paraplegia, Aids, even BALDNESS!!
Just goes to show, the money isn't in the cure. It's in the treatment and "prevention".
What we need is a return to what is fair and balanced.
Perhaps today it should be less ... say 5 years. After that it automatically goes into the public domain where anyone can do anything they want with it. Imitation is, after all, the sincerest form of flattery.
Want an example of what will happen? Look at Ethernet. Designed by Xerox and released into the public domain. Now look where it is ... EVERYWHERE!
"Although the song's lyrics were written by Verve vocalist Richard Ashcroft, it has been credited to Keith Richards and Mick Jagger after charges by the original copyright owners that the song was plagiarized from the Andrew Oldham Orchestra recording of The Rolling Stones' 1965 song "The Last Time".
That remix is not without reason in this video but I cant tell you who's remix it is sorry.
Hope the author of the wikipedia article doesnt come after me for this...
now then u own your kids? or do ur parents own you? no dude, no way someone can own an idea. I think that others creaton should be respected but for no reason must be owned. as a muscician i think that if i write a song and ppl listen it then im happy. if i found someome remixin or createing something new with it,, then even better. that means that they really liked and want to go even further with it, thats what creation is about
they play Girl Talk as the underdog here but he only seems that way because he doesnt make as much money as the people he is sampling. imagine if he was playing all those sold out shows and huge festivals making all that money sampling unsigned underground artists. thats the next step in this game. the mash-up artists are all going to go pro like girl talk but they will have exhausted all the pop music and move on to sampling from the little guy.
Absolutely! I hate corporations guarding their chests full of gold and I hate arrogant little Mac geeks pretending to make music who then complain about it when they get done for doing something they knew was illegal (and more importantly artistically sterile).
I actually find the documentary insulting...to my intelligence. One sided and polemic, the arguments in it are irrational, and he pulls EVERY cheap shot in the book, from parading out children, HIV etc. I think this documentary will "sell" well to those who wish to believe, or who lack the cognitive ability to think through the complex moral/ethical arguments, but it may damage his cause in the eyes of the thoughtful....
Whether this video is free or for sale is non sequitur to my comment. You are certainly free to "totally disagree" with my comment, if however, you do not think this a laughably one-sided and poorly argued presentation, regardless of what you thiink of the appropriation of copyrighted material, then I suspect we will have very little in common intellectually.
i think you need an ego check buddy.. "I am wise because I know nothing", look into it, if people have HIV and American drug companies virtually hold others to ransom by it and this point can help your argument why not sight it, if Disney bullies a day care center why not sight it, if it is your point you are trying to make.. how would of you balanced the argument? the documentary's point is to highlight the flaws in the intellectual property right laws ..
@datacipher There are plenty of intelligent people of this world, the way you go on about your makes you rudely arrogant and your point inconsequential, and my studies have a lot to do with intellectual property rights, i will not judge your intelligence, to me your just a name on screen
What you need to do is take some logic courses at a real school, where they will teach you that ad hominem attacks against me most certainly do not render my point inconsequential. You can argue like a 5 yr old and call me a "poo poo head", but that wont' make valid arguments suddenly appear in this film. Had you actually done real studies on property rights (ie, not "research" on the internet), you'd realize that these are complex issues that this film does not even begin to address.

@datacipher , i called you arrogant not a poo poo head and i have been to real schools, got real degrees to, 3 of them. Political Science, Communications and Audio Engineering the 2 of those 3 have a lot to do with this subject,
Interesting. At most real schools, getting two true degrees takes an absolute minimum of 6 years. Since audio Engineering would have few overlapping courses, that would be an additional 4. Difficult to do by the age 25 you claim. It's also difficult to get a political science degree at real schools without learning that one "cites", not "sights". Nevertheless, this is itself, irrelevant, and another argumental fallacy.
@datacipher yeah i proof read my essays, not really to concerned about youtube comments and considering i got into university on my 6th form grades so did not have to do 7th form i have had actually had 8 years to do them, It also called cross credits, it allows you not to do the similar papers twice, Your argument is i am smart this doco wrong, it rather weak bro, I believe in free creative societies, sorry if that offends you,
Hmm...so it seems you were unable to interpret even these simply youtube comments, or are you purposely misrepresenting my argument? It seems the latter is more likely, and thus, you again commit an argumental fallacy, and a very unethical/juvenile one. I am waiting for you to reply to the actual arguments, and not misrepresent mine.
PS. I realize you are a huge girltalk fan, but that does not make this documentary any more valid.
@datacipher this doco is not just about remixing music, you are trying to simplify it to that, HIV is about the rites to make medicine, it is about what we are allowed to consume in the public domain vs what we can reproduce ie creativity been been controlled an oppressed, You seem to have a a very closed stubborn mind hence why i quoted Socrates to you before
Again, this is vague rhetoric. The central theme of the documentary was clearly about remixing music, NOT about the tangential and non-sequitur analogy of HIV medicine, which covered a few minutes, but obviously succeeded in pulling the emotional strings of many. However, I am willing to play your game. Please state CLEARLY, your rational to justify:
1.the appropriation of music
2.the right to take and use the intellectual property of pharmaceutical companies

Then that is NOT a degree. It's difficult to imagine that somebody who had 2 other genuine "degrees", would then devalue them by calling a 9 month program a 3rd degree. This calls into doubt your entire claim.
@datacipher i would not call 9 months of hard work degrading, other places take longer because they have holidays, i chose not to. Your only points have been that they should not of used HIV or children, both of which i have responded to and then you have tried to attack my intelligence, yeah i am a Girl Talk fan, just as much as i a Sam Cook fan or Madlib fan or a Dire Straits fan, nothing to do with it,
If by respond, you mean that you posted "why not sight (sp) them?". Then yes, you responded. If you consider that woeful non-argument a "response", then again, we'll make little progress. It is tantamount to: "why?" "umm.....why not?"
See, my post above if you wish to respond, state your ethical justification for the above cases, and the relation between them; then we will have actual substance to work with.
You seem to have misunderstood. The documentary did not present any rational ethical defense for music appropriation, please state yours, or alternatively, what you think the film's was, and I will gladly respond. However, please state them clearly, without rhetoric, and we can discuss this properly.

SIgh. Let us say for arguments sake that those 2 examples are indeed "flaws" in intellectual property rights laws (each of them, while polemic, are certainly arguable). How would you then say either of them justifies breaking intellectual property rights to remix music, which is the CENTRAL theme of this film? NO, it is NOT ok, for the rational, logical human being to "sight" (SP!) other flaws if they are not analogous to the point one is trying to make.

if Girl Talk wants to make mashups he should go ahead and do it. but he shouldnt be surprised when people want him to pay for the music he is sampling. in the same way that he would be expected to pay for the program that edits it or the speakers that play it.
if other artists dont want him using their work he should respect their wishes, especial if he plans on selling and playing it for profit.
i find it extremely hypocritical and ironic that i cant find the movie on any online streaming website. I saw 15 minutes of the film and would love to see more but i cant find it anywhere. i dont live in the states so nu hulu or any of that only us bullcrap. i just want to watch it for free. practice what you preach Brett gaylor(d)
you can find it on PirateBay (and other torrent sites), Rapidshare and streaming (in the site of the film there is a list of sites for watching it in streaming)... it's free... there are not problems...
I love the bittersweet symphony remix and would really like to have it. Anyone know where to get the song? I've tried and now I'm tired... anyone? please?
This comment has received too many negative votesshow
ok let me make this real clear for those of you who dont understand yet....it takes money to make music and movies. You think media companies decide to spend millions on a movie or album so they can give it away to "spread art and freedom" what kind of ingnorance is that? Its wanting to have free stuff without paying for it, thats what people want so dont say its freedom of expression, the material is not yours, its a companies and for you to have it, you need to pay for it....
You can now download the full movie (at a "pay what you want" model) at the film's website - Google the film's name to find it, since I can't post website addresses in Youtube comments. Click on the 'Rip It!' section to find the download.
I just saw the movie, and it's great!!! Good job you guys!! Large companies like Disney sucks, they are taking over our lives and we can't make anything based on what they made.
just thinking of all the concepts and ideas you can bring to light am so reminded of a happening, totally against the law, yet, was so good they couldn't stop it. This is youth coming up and crowding out the old ways. It, can't happen too soon, time to flower power to the people, let them know the vegetables they grow, at spitting on the seeds to put their DNA on it, will work wonders for them, spread peace, plant a tree. This is breaking through the thought barriers lets go cosmic
Does anyone know the name of the Bittersweet Symphony remix that's in this trailer? It's also in the movie, they said it's from a Brazilian artist but I can't figure out who.
Also, for everyone complaining about this movie not being on the internet, it's on the film's website...
@ longlatvan: That is the mix that Girl Talk used, but it's NOT the high-energy sped-up version from the end of the trailer. I really want to find it too.
Now are we going to download or rent this movie?

@MarkusHomer I'm pretty sure it's not meant to refer to 'Rest in Peace', I think it's rip, as in rip a CD, rip off a riff, etc.
And to anyone watching the trailer, this is a good movie and worth watching.

@nfb its probably from "in rainbows". they promoted remixing by putting samples and such on their in rainbows cd so people could remix it.. radiohead OWNS! :)

This just aired in Australia tonight 5th January 2010. I loved it but how come no-one is talking about the medical ideas that are strangled through patents and possibly inhibit forward process??? Cure a f&%##@ disease you greedy bastards!!!!
DastardDevoyd 2 years ago

EVERYWHERE!

Who knows who made the kapuira kind-a song at the end. it's a remix of The verve, but who's that genius who remixed it?
Pheij1989 2 years ago
@Pheij1989
Actually The Verve themself sampled those strings from The Rolling Stones and lost all the rights to "Bittersweet Symphony".
Scamcoder 2 years ago
@Pheij1989 Qote from wikipedia:
Scamcoder 2 years ago
Shame on the american authur rights!
I know it's an rollingstone remix, but then again.. That Kapuiera kind of beatbox which is mixed with it is genius!
I'll hope the american system of copyright wil fall a part soon!

Wut do u mean? that u own what you create?
now then u own your kids? or do ur parents own you? no dude, no way someone can own an idea. I think that others creaton should be respected but for no reason must be owned. as a muscician i think that if i write a song and ppl listen it then im happy. if i found someome remixin or createing something new with it,, then even better. that means that they really liked and want to go even further with it, thats what creation is about
pekisi 2 years ago
they play Girl Talk as the underdog here but he only seems that way because he doesnt make as much money as the people he is sampling. imagine if he was playing all those sold out shows and huge festivals making all that money sampling unsigned underground artists. thats the next step in this game. the mash-up artists are all going to go pro like girl talk but they will have exhausted all the pop music and move on to sampling from the little guy.
CarbonSuit 2 years ago

yes i did, its totaly one sided and doesnt spend anytime discussing the rights of the artists he is making money off of.

Absolutely! I hate corporations guarding their chests full of gold and I hate arrogant little Mac geeks pretending to make music who then complain about it when they get done for doing something they knew was illegal (and more importantly artistically sterile).
fehuperthro 2 years ago 2
I actually find the documentary insulting...to my intelligence. One sided and polemic, the arguments in it are irrational, and he pulls EVERY cheap shot in the book, from parading out children, HIV etc. I think this documentary will "sell" well to those who wish to believe, or who lack the cognitive ability to think through the complex moral/ethical arguments, but it may damage his cause in the eyes of the thoughtful....
datacipher 1 year ago
good thing he not trying to sell it, you can download it for free, totally disagree with your comment
DozaDMN 1 year ago
@DozaDMN
Whether this video is free or for sale is non sequitur to my comment. You are certainly free to "totally disagree" with my comment, if however, you do not think this a laughably one-sided and poorly argued presentation, regardless of what you thiink of the appropriation of copyrighted material, then I suspect we will have very little in common intellectually.
datacipher 1 year ago
i think you need an ego check buddy..
DozaDMN 1 year ago
@datacipher There are plenty of intelligent people of this world, the way you go on about your makes you rudely arrogant and your point inconsequential, and my studies have a lot to do with intellectual property rights, i will not judge your intelligence, to me your just a name on screen
DozaDMN 1 year ago
@DozaDMN

DozaDMN 1 year ago
@DozaDMN
Nevertheless, this is itself, irrelevant, and another argumental fallacy.
datacipher 1 year ago
@datacipher yeah i proof read my essays, not really to concerned about youtube comments and considering i got into university on my 6th form grades so did not have to do 7th form i have had actually had 8 years to do them, It also called cross credits, it allows you not to do the similar papers twice, Your argument is i am smart this doco wrong, it rather weak bro, I believe in free creative societies, sorry if that offends you,
DozaDMN 1 year ago
@DozaDMN
PS. I realize you are a huge girltalk fan, but that does not make this documentary any more valid.
datacipher 1 year ago
@datacipher this doco is not just about remixing music, you are trying to simplify it to that, HIV is about the rites to make medicine, it is about what we are allowed to consume in the public domain vs what we can reproduce ie creativity been been controlled an oppressed, You seem to have a a very closed stubborn mind hence why i quoted Socrates to you before
DozaDMN 1 year ago
@DozaDMN
3. relation between 1&2

@datacipher oh an it takes 9 months with no holidays for Audio Engineering
DozaDMN 1 year ago
@DozaDMN
Then that is NOT a degree. It's difficult to imagine that somebody who had 2 other genuine "degrees", would then devalue them by calling a 9 month program a 3rd degree. This calls into doubt your entire claim.
datacipher 1 year ago
@datacipher i would not call 9 months of hard work degrading, other places take longer because they have holidays, i chose not to. Your only points have been that they should not of used HIV or children, both of which i have responded to and then you have tried to attack my intelligence, yeah i am a Girl Talk fan, just as much as i a Sam Cook fan or Madlib fan or a Dire Straits fan, nothing to do with it,
DozaDMN 1 year ago
@DozaDMN
If by respond, you mean that you posted "why not sight (sp) them?". Then yes, you responded. If you consider that woeful non-argument a "response", then again, we'll make little progress. It is tantamount to: "why?" "umm.....why not?"
See, my post above if you wish to respond, state your ethical justification for the above cases, and the relation between them; then we will have actual substance to work with.
datacipher 1 year ago
@datacipher you have not presented a counter argument to this doco, you have just criticized the way it was done.
DozaDMN 1 year ago
@DozaDMN
You seem to have misunderstood. The documentary did not present any rational ethical defense for music appropriation, please state yours, or alternatively, what you think the film's was, and I will gladly respond. However, please state them clearly, without rhetoric, and we can discuss this properly.

@DozaDMN
SIgh. Let us say for arguments sake that those 2 examples are indeed "flaws" in intellectual property rights laws (each of them, while polemic, are certainly arguable). How would you then say either of them justifies breaking intellectual property rights to remix music, which is the CENTRAL theme of this film? NO, it is NOT ok, for the rational, logical human being to "sight" (SP!) other flaws if they are not analogous to the point one is trying to make.

if Girl Talk wants to make mashups he should go ahead and do it. but he shouldnt be surprised when people want him to pay for the music he is sampling. in the same way that he would be expected to pay for the program that edits it or the speakers that play it.
if other artists dont want him using their work he should respect their wishes, especial if he plans on selling and playing it for profit.

ok let me make this real clear for those of you who dont understand yet....it takes money to make music and movies.

In some countries human rights are ignored.
In the west human rights are replaced by copyrights.
The right to copy, how rediculous can you get? Everything about the west is a copy of an imitation in some way or another.
But god forbid if you would download stuff illegal or get inspired by something and want to add to that something...
