It would have been easy to make a succesful aircraft that got near the speed of sound, rather than going past it. Why go supersonic? You don't save much time unles you're doing a thousand mile trip, most of the time lost in flight is lost on the ground.
So the test pilot died because somebody got too ambitious and the unsuccessful plane fell apart.

If you are refering to John Denver. You can find the FAA report on-line. JD had been in Re hab and had a clean toxicology screen in the autopsy after the Vari -EZ crash. He had just bought the plane and got it back from an inspection by an A&P. Crashed while trying to switch fuel tanks he was unfamiliar with.
John Dever died because of a mistake. Not the airplane in general. Plenty of Home builts have to be FAA certified just as any assembly line A/C does, and often times by people who love and cherish flying and their aircraft. Most never crash. But, just as in any other market, mistakes are made, and people die. But more people die in Auto accidents a year than have ever died in aircraft, home builts included.
JD died trying to change tanks located over his shoulder using vise grips in stead of a proper fuel valve handle. While trying to see what he was doing, he flew into the water. This type of maintenance is common when the owner built the plane and therfore can do all maintenance.

because it was 13-14 years ago and no kits were ever produced due to the accident that occurred. The production was sold to an aeronautics firm in canada, but that's the last anyone ever heard about it.

vertical stabilizer failure at 380 kts....resulting in the the plane pitching up violently and tearing apart. supposedly they fixed that problem
