That is illegal, if you use a small portion (I don't remember how much exactly)of copyrighted audio material inside your own original material it is called "sampling" and it is not copyright violation. This has been introduced since lot's of music contains themes from other songs blended into a different song. So they can't claim a copyright violation for a couple seconds of a copyrighted song, not even if the entire 10minutes contained 300 distinct 3s samples.
