As far as confusion about why I served, I never had that problem. I took an Oath that I honored from my 1st day in uniform to the last. First of all, they are not being tried in civilian court, despite what Fox may tell you. The trial is being held in a FEDERAL COURT, where federal crimes are tried. That's part one. Krauthammer tried to belittle the court system by referring to the federal court where Khalid Shiek Mohammed is going to be tried as civil court. Civil court is where you appeal parking tickets, small claims suits and resolve family matters. There is no comparison between the two. I know, I work in the court system as a juvenile probation officer with family court. Civil court is a general term for courts that do not hear criminal matters.

I think Eric Holder definitely wants to go through with it. The problem is that if he pushes too hard, Republicans and conservative Democrats in the Senate will call on Obama to remove him. Holder is a pretty independent prosecutor and will not shy away from pressure from Obama or the Senate but I don't think this is a headache the rest of the Democrats want. If they press to hard, they'll give control of Congress back to the Republicans.

and why didn't AG Holder look into the relevant case law regarding trying an enemy combatant captured abroad (in a war theater) being tried in criminal court? why would a prosecutor (one who cared about making a successful prosecution) not look into the relevant case law? Holder's answer suggested that he did not even look, did not do his due diligence that would be necessary before authorizing a criminal prosecution and preparing a successful prosecution? Is this incompetent? or sabotage?
