To me, Near's Theme sounds more like a Marimba (keyboard instrument similar to xylophone except bigger and sounds alot better) and an electric guitar, both of which 'parallel' the piano and acoustic guitar sounds in L's Theme.
U can bring back the dead or else the story will go bad. Although I do admit him dying sucked because his real name was never introduced like Mello's.
