  • This man is having trouble wrapping his head around a simple hypothetical: if Jack Bauer existed, would we convict him as a criminal? And Scalia says, no, we wouldn't. So why convict real government agents, who may confront very similar situations?

    It's true that, sometimes, we cheer for fictional characters whom we'd condemn in real life.

    However, Scalia is saying, if we cast this man as a hero in fiction, we should seriously examine whether we want to imprison his real-life counterparts.
