I think he's in Standard D (DGCFAD) with the capo on the 5th fret. It's sharp, though, and with a little rough calibration on my chromatic tuner 446-448hz for A seems to do the trick. Tricky to be sure.

I learned this one by ear from this vid. and Im 99,99% sure he's playing in D standard (DGCFAD) with Capo on the 5th fret. which means you can play it in Standard tuning (EADGBE) with capo on the 3rd fret. Most of Newtons stuff is played in DGDGAD but sometimes he plays them a half step tuned up. Like in "To the light" and "I need something".. so there you go (Y)

In response to the confusion about the tuning: The fingerings look exactly like those of the capo 6 version we all know, making it unlikely to be DADGAD or some variant, so perhaps the audio has been transposed in the recording.
