The police operate by the definition of particular laws; and if you cannot operate with respect to those definitions, you cannot enforce the law. @Sneezlebob No, they didn't; the officer didn't even inform Kokesh that he was under arrest. He kept saying 'this is your last warning', but never once said 'sir, you are under arrest'. He put his hands on a civilian who was not formally under arrest, according to police protocol, which an officer cannot do. Furthermore, while Adam was on the ground, not resisting, the officer proceeded to choke Adam, which is clearly assault.

The police operate by the definition of particular laws; and if you cannot operate with respect to those definitions, you cannot enforce the law. At no point did Kokesh resist the officer, he was slammed to the ground, and while he was lying there, he was choked.

He didn't resist arrest, he was slammed to the ground, even though the police officer did not tell him he was under arrest, then he proceeded to choke Adam while he was on the ground. @MegaDominator2000 Please don't take this the wrong way, but I hope that the next innocent person to get shot from a SWAT drug raid-gone-awry is you. It's not that I hate you, or that I wish you harm. I don't even know you. It's just that for some people (such as yourself) the only way something can sink in is for something bad to actually happen to them. And then, like magic, they suddenly get it. So here's to you, one day, getting it.
