Out of the 37 pages of testimony, there's only one that contains any reference to it being non-consensual and that section has all the hallmarks of a coercive statement.

He didn't drug her, he found a qualuude in Jack Nicholson's bedroom in a box (he wasn't even sure what it was), took a 1/3 himself and offered another part to her out of politeness. He drugged himself.

Even if she were to have taken the stand and repeated her Grand Jury testimony, you would have a very hard time persuading a jury of 12 that if he took a drug himself, offered her the rest of it as an afterthought and she took the independent decision to take it herself constitutes "drugging"; that's not "drugging" that's "doing drugs together".

@bigtrucksreview If the victim will not take the stand or does not allege that it was wholly non-consensual (as is the case here, the complaint was made by the girl's mother and the case tried with the State of California as the plaintif, not the girl), you can still convict for the statutory rape charge (Rape of a Minor - Person Under 14) if the prosecution can persuade the jury a reasonable person can accurately differentiate a girl of 13 yrs 50 weeks and from one of exactly 14 years on sight.

"Simple" rape has to involve an allegation by the victim, and the prosecution has to persuade the jury it was non-consensual.

Out of the 37 pages of testimony, there's only one that contains any reference to it being non-consensual and that section has all the hallmarks of a coercive statement.

@darkdaej Her mother made the complaint, she was 2 weeks too young to consent under law at the time - so whether it was consensual or non-consensual, if a report is made by a third party (in this case her mother, who was freaking out), the police are obligated to investigate it as statutory rape. He didn't drug her, he found a qualuude in Jack Nicholson's bedroom in a box (he wasn't even sure what it was), took a 1/3 himself and offered another part to her out of politeness. He drugged himself.

They did not want him punished, all they wanted was his public acknolwedgement that it had occurred, it was wrong (and illegal) and the responsibility was his. Which he admitted.

He threw himself on the mercy of one man, Judge Rittenband, who decided to to break his word and act like John Wayne by making an example out of the famous director to get his name in the paper. If he had gone along with the recommendations of the probation report and deported him with time served, this would all be history.

He did a really stupid thing that he would not have done ordinarily whilst under the influence, he's accepted blame and full responsibility and never intends to make the same mistake again. Jailing him is in nobody's interest. Recommended sentence is therefore probation.
The judge chose to ignore the medical professionals and go his own way.

While you do present valid points, in this particular case, Polanski sexually assaulted Samantha Gailey.
The court transcripts are more than clear and it wasn't "statutory rape" because she was underage. She was given champagne and a quaalude along with it (I don't recommend this to anyone...).
She faked an asthma attack, said no multiple times, and did not physically fight back because she didn't know how to get home and was scared of this much older man.
