Preventative detention has historically grown beyond its original bounds. Given that the government has already grown beyond Constitutional bounds via "creative interpretation" in most areas. It seems very likely that preventative detention will grow beyond the limited bounds of to include US citizens that are merely inconvenient to government officials rather then real terrorists.

The whole point of the US originally as a republic was that there would be a few laws in which no government, nor body of people with enough votes could change. Your rights to life, liberty and the pursuit of happiness for example. Nothing should ever be allowed to vote those away even if you have enough votes.

Without a few of those inalienable rights, there would be no real democracy either. After all, you could vote your right to vote away.
