Technically the only people with the rights to publish/upload this footage are those representing the network who aired it, but unless someone else starts making money off it or it's a particularly pedantic network (or someone dobs you in), it really doesn't or won't matter.

My point was that you can't call a breach of YouTube's SA 'breaking the law'. Because that's simply BS. Unless you know the precise terms of the Copyright legislation applicable to the poster in their home country, uploading the video could be anything to a full breach of the local Copyright Act to an act not amenable to any local legislation/law.

The broadcast, as a Copyright 'original works', is owned by the network that produced it. So neither 'Prozacbear' or 'Tim Minchin Live' needed Tim's permission to upload it. Further, neither of them obtained permission to upload it from the true owner of the footage. 'The point' is that you are both drawing invisible legal/moral lines that don't exist.

As it is, copyright law in its most literal state would say that it belongs to the people who filmed it yes, but that's like saying that all music belongs to the recording studios and not the artists who made them, because the studio filmed the video.

The artist is the one who can sue for overly-derivitive (copying) songwriting, but any publication that breaches copyright of a recording is up to a record label (unless independently produced), or, in this instance, the network on which the footage was published.
