No, you can get games on the zune using XNA Game Studio 3.0. It is made by Microsoft, and is free. Google it, you could find it.

I think with the new firmware you'll have to wait for XNA Beta to come out to re-add all the games you previously had and new ones. That's just what I've heard though.
