Seconfly, the only damages suffered were minor inconvenience, and YouTube did the work of restoring the videos anyway. You can't get money for damages that are not experiences. Tiny punative damages is all that could have been had, at great inconvenience and financial output to persue them. Thinderfoot would have been the loser in the end really.

This situation would never have ended in court. Those whose copyright is breeched are required by US law to offer settlement before litigation, which typically results in cases like this in nothing more than apology and cessation. Also, the YouTube regulation is not legally binding. Whenever someone creates a photogrpahic image, they instantly own copyright of it. Corporate fair use rules do not make or change law. I know this because I am an ex-professional photographer.
But they are not allowed to post the video verbatim without interjections of commentary that make parody or commentary of it. That is a breech of copyright law. There are quite a few copyright infringements of my wrok on YT, and i've had a few removed just to show the account owner that I have the power to have them removed. For the most part, i don't because they are only provideing me another outlet for my work, and people don't fall for sock accounts anyway.

just read the terms of use rather than denying it. by posting videos here you grant every YT user a non exclusive access to your material and his vids fall under fair use.
The terms of use do not and cannot take away a person's copyright. Once more, copyright is not removed by fair use. Fair use is what? FAIR USE. Not ownership, nor the right to publish verbatim.

No. You do not gain through ToyTube the right to reproduce or distribute someone's copyrighted work unless it is under Fair Use. Fair Use does not include verbatum duplication or distribution.
When someone uploads a video toy youtube they agree to the statement I just quoted, meaning they are allowing other users of the website to "use, REPRODUCE, DISTRIBUTE," etc etc their work.

Seconfly, the only damages suffered were minor inconvenience, and YouTube did the work of restoring the videos anyway. You can't get money for damages that are not experiences. Tiny punative damages is all that could have been had, at great inconvenience and financial output to persue them. Thinderfoot would have been the loser in the end really.
VenomFanX's mistake was being zealous about his images, that's all. It was hasty but not really damaging in any way.

This situation would never have ended in court. Those whose copyright is breeched are required by US law to offer settlement before litigation, which typically results in cases like this in nothing more than apology and cessation. Also, the YouTube regulation is not legally binding. Whenever someone creates a photogrpahic image, they instantly own copyright of it. Corporate fair use rules do not make or change law. I know this because I am an ex-professional photographer.

2 problems
1- when you upload a video onto youtube any other user is allowed to use content from that video, see terms of use.
2- his videos fall under fair use. Tf00t is obiously not making a profit and is making vids strictly for educational purpouses.

But they are not allowed to post the video verbatim without interjections of commentary that make parody or commentary of it. That is a breech of copyright law. There are quite a few copyright infringements of my wrok on YT, and i've had a few removed just to show the account owner that I have the power to have them removed. For the most part, i don't because they are only provideing me another outlet for my work, and people don't fall for sock accounts anyway.

Nothing in YT's policies that states anyone can copy another user's videos verbatim. Doing so is a copyright violation, and YT supports it by complying with the reqquest to remove them.
Allowing acces is not copying and publishing. non-profit or not, videos uploaded to YT are copyright owned by thier maker. It's the law.

The terms of use do not and cannot take away a person's copyright. Once more, copyright is not removed by fair use. Fair use is what? FAIR USE. Not ownership, nor the right to publish verbatim.
Go read about copyright and media and learn a thing or two.

No. You do not gain through ToyTube the right to reproduce or distribute someone's copyrighted work unless it is under Fair Use. Fair Use does not include verbatum duplication or distribution.
