  • What lysander spooner fails to understand is trust law and probate law think why do people call the originators of the constitution founding FATHERS. Tell me something if someone creates something can it not be passed down to an heir or an assign? what is a perpetual union? The constitution is not a contract because a contract is something for something. Rather its a trust. Grantor trustee beneficiary relationship. Which is how they converted a public trust into a corporation in 1871.

  • I suppose none of the people defending it on here have ever tried to use it in their defense in court just to be told that they weren't a party to the constitution so it doesn't apply to them.

See an oath is required if one is to leave there natural citizenship. And it just so happens to exist 2 such in the Bounds of these united states,. Sate Citizenship natural

  • @billyjoejimbob75 And a federal citizenship called US citizen. All oaths are under USC title 8 section 1481. The natural citizenship is the state proof is the birth certificate is a state issued document. Another case to prove all laws congress creates is solely for government IE administrative laws is Yickwo V Hopkins 118 US 356.

  • statists react to this book similary like religious people react to "God Delusion" or any other book questioning religion (not necessarily bashing it). The idea of a state is a religious idea, that some people are good enough to rule over other people and decide what's best for those other people without their consent.

  • @MaikUniversum what like a parent? what ever happened to Jeffersonian idea of self governing. A child cannot self govern to the extent of there parent. No the true force in government should be of that of advice that is it and if an injury occurs then the common law and equity should be brought forth.

  • @clearly When they applied for a position with in that government freely as public servants then yes the constitution must be applied as a contract much like a trustee is obligated to the beneficiary by authority from the grantor.

    however, once an oath is sworn to uphold said document then it must be upheld. If it is not, then we should assume it will not be. The grey subterfuge is where the problem lies. Lets have a discussion on what the people want... a Police State run Slave society, or a free humanity.

  • I have a love/hate relationship with Lysander Spooner. I love him because his writings are so incredibly thought-provoking, morally consistent, and logically irreproachable. But I hate him because he made the idea of "limited government" look absolutely ridiculous to me, and popped my wishful thinking minarchy bubble forever! Now I'm always depressed and miserable, wondering what can be done to peacefully establish a voluntary society, or at least severely undermine today's non-voluntary one.

  • @RationalDischarge I think most anarchist people at that time were actually minarchists according to our modern standard, so it is not that bad. Just like many "atheists" in middle ages still believed in some sort of magic or superstition.

  • You can't sign a contract for your unborn child stating that they will pay $20 a month for the rest of their life in exchange for a monthly bushel of apples. The person taking part in a contract is the one to consent to a contract. Once the child is older (s)he would be able to freely break the apple contract.

    If you agree with this then I don't see how you could disagree with Lysander.

  • wrong. natural law is the highest. the point of the constitution was to protect our natural rights. but this experiment has failed. thus, the recommendations, nay, our duty, as laid out in the declaration of independence ought be our guide.

  • When I say "perspective" I don't mean "opinion". A perspective has to do with the underlining assumptions one makes when they approach an argument. This is not to say the those perspectives could not be predicated on false assumptions. To say that "The people" are "the government" is a perspective predicated on false assumptions, but it is a perspective nonetheless.

  • Well, I can't correct what is your opinion, but I must disagree. "The people" represents any large number of humans, where as the "government" is in fact an organization. You are correct that the government does represent itself as a legal stand in for the people, but this is only part of the public relations used by this organization.

    It's a matter of perspective really. In any case BMK110's would still seem strange:

  • Sufferage is powerless, with it only being able to be exercised periodically, and containing no guarantee a electee will act as expected.

  • I think it's safe to say that the election of the president is the people (you and I) recommitting the contract of the Constitution and its Authority. When the president is elected (by the people) he is sworn in, by oath he states he will up hold the Constitution. I would say that by people voting him in and him swearing in is a renewing of the Constitution by the people of America.

  • Spooner adresses this objection. Voting at best could only be consider consent for a period on 4 years. And not all people vote.
