The refs have nothing to do with it. Although it may seem as though Ness was in control, he did not have control of Dennis' hips with two hands and weight on the legs. By definition, since this is not freestyle, as long as Ness didn't have control of Dennis' hips via both of his legs, the situation can be deemed a scramble situation and neutral position for both wrestlers.
