The only way to have standing is to be affected by it directly, namely, get arrested and have it apply to you. However, if it applies to you, you're denied a lawyer, thus cannot challenge it in court. It's rather brilliant, actually.
As for the police state... the Rubicon of tyranny is always two steps ahead, it seems.
