  • Can't anyone dispute a ticket received at a DUI checkpoint and get it dismissed? I'm sure they can but what stops these assholes from doing this. The scope of the checkpoint is to check sobriety. That's it. Once they determine if a suspect is not drunk, it's over. They have no legal right to detain that person any longer. Any evidence gained after that can be suppressed in court and would be inadmissible. But they don't care. We need some type of recourse so they can't continue this.

  • I think its funny that someone says its unconstitutional, the Supreme Court tells us what is unconstitutional and was is not. If the Supreme court says its constitutional than it is...that's the way it has worked since the beginning. So this is constitutional, there is nothing wrong with it. You cant quote the 4th amendment with out quoting every supreme court ruling on said amendment.People like this are PRO-CRIMINAL not pro rights.They are against the police stopping crime.end of story.

The Constitution does not say it only applies in courtrooms, or else you would have no rights, EVER. "Unconstitutional" is a term used in court, sure, but the court is there to fix mistakes made OUTSIDE of court, where the Constitution is violated. Elsewise, what's the point?

  • Hey moron its me again...........traffic violations suchas the ones these officers identified on the vehicles led to other serious crimes. Of course you wouldnt know that your too busy trying to confront the police all the time and question there authority. Traffic stops of minor traffic violations has lead to the arrest of many serious criminals. So how is that unconstitutional moron. They asked, "You had anything to drink tonight?, etc." They then asked for license & proof of insurance & then they wanted to know who's bicycle was in the trunk.  I started telling them that they were in violation of The Constitution & that they had no probably cause to stop my freedom of movement. I also told the young officer that I'm former law enforcement & familiar with my rights. They moved me thru w/out proof of insurance!

  • It would have been interesting to see what would have happened if you didn't obey his unlawful command to stop filming. I can understand some people giving in at that point as its up to the individual and their own pocketbook to make that tough judgement to proceed further and to allow the officer to make a false arrest on them.

You are correct, you don't need to provide them with ID at that point, however, it isn't probable cause but only reasonable articulable suspicion that is required for them to "demand" you to identify yourself. Its a lower threshold to satisfy than probable cause. They can "ask" you for ID all they want. Asking and demanding it through force or threat are two different things.

  • Check points are not unconstitutional, we have been using them for years and they have been challenged and those challenges have lost. There are certain guidelines which must be followed, which are not that difficult.

    This guy should go back to school or read up on the case law.

    As for him photographing and being forced to turn off the camera? He was never ordered to turn it off, so he did so voluntarily.

I guaruntee that if police were to search everyone's home on a given street block, they'd find something illegal. That doesn't make it okay to hurt the innocent.

Gov. cannot keep you 100% safe, 100% of the time. That is YOUR responsibility. Shredding the 4th Amendment to run checkpoints is not the answer. 350,000 people DIE A YEAR from drug interactions. Hundreds of thousands of illegals pour into this country a year from Mexico driving down wages and sucking down the economy. How about we stop that?

  • @mrjustin5 Check out checkpoint USA. A true American patriot. He deals with border patrol and US Customs, but his points apply to domestic cops as well. Next time you are pulled over, ask them, "Are you being detained and that they need specific and articulable facts to justify that detainment." Usually that lingo right there will shit them down. Then ask, "Am I free to go." Also, cite WIRETAPPING LAW, which states you have a right to record them while they are out in public.

  • @mrjustin5 See, pigs tend to think that they are above the law. We need to remind them that they are THE SERVANTS OF THE PEOPLE (ALONG WITH POLITICIANS) AND THAT THEY ARE HERE TO SERVE US. Next time, tell those fools that they are the servants of the people, emphasize servants and that their job is to serve you and that you, as a tax paying citizen, have the right to keep an eye on them and make sure that they are doing their jobs as servants of the people.

Video, audio and photographic evidence will be used in the prosecution of criminals who commit common law crimes during the enforcement of statutes. Here in England many military and ex military are very aware that massive fraud has been used to stimulate the so called war on terror. It's a very bad time to be the despicable vermin who wish to dominate their neighbours. It's time for Lawful Rebellion.

In Certain counties in Texas it is "lawful" for police to take your car, house, money in your wallet, all without no due process, no warrant, no court order and seize it as part of "Drug enforcement". The Sheiffs and government then get to KEEP the money. I forgot the name of the video and I cant find it.

  • Also if you are on public property ie the sidewalk YES you may videotape anything...dont let them get away with that...if you are on private property then AND ONLY THEN you must have permission

  • However they do not know how to deal with someone who has done nothing wrong questioning them being there and willing to fight it these people are dangerous because they have a true backing from the founding documents and are going to be supported in the court if they fight it...but again they just challange you to fight it knowing the epense it costs for the courts and most people dont have the money or time to fight it

  • The thing is if a police officer is alone on the road or even with a second officer in their own car and they notice someone driving erratic then it is lawful to pull them over search the vehicle and so fourth as long as the charge or the belief that the charge warrants a search via probable cause (DUI belief seach the car for open containers) However it is unlawful to pull someone over for a taillight or cracked winshield and then demand to search the vehicle because the charge doesnt warrant

  • The Police is not the problem, they are the symptom. The problem is you and your neighbors. who refuse to protect your Rights. Every State must have our proposed Amendment or they will legislate everyone of your rights away. Your most important right you no longer have. If they can prevent you from owning property, you are a slave of the State. Prove me wrong.

  • The Supreme Court is not the Constitution. Any Jury can override any bull spouted by any Judge. Judges do not make Law, case law is bullshit and they know it.

  • @propertyrightsnow No, no, no...the jury decides on a case but the judge can ALWAYS over rule the decision. You have no idea how powerful judges can be. Especially federal judges...
