Can't anyone dispute a ticket received at a DUI checkpoint and get it dismissed? I'm sure they can but what stops these assholes from doing this. The scope of the checkpoint is to check sobriety. That's it. Once they determine if a suspect is not drunk, it's over. They have no legal right to detain that person any longer. Any evidence gained after that can be suppressed in court and would be inadmissible. But they don't care. We need some type of recourse so they can't continue this.
There is no expectation of privacy on a city street or public sidewalk. As long as you are not in a place where you feel that others can see you and what you do there is no expectation of privacy.

I think its funny that someone says its unconstitutional, the Supreme Court tells us what is unconstitutional and was is not. If the Supreme court says its constitutional than it is...that's the way it has worked since the beginning. So this is constitutional, there is nothing wrong with it. This statement is false. There is no requirement to ID just because some officer asks you to. He must first have reasonable suspicion of criminal activity and you are involved with that activity. Also, states must have enabling legislation in effect. Identification can be given verbally.

Actually you do have to provide them with an ID when they ask you for it, courtesy of a decision made by the US Supreme Court recently. But you can still film. Just keep your mouth shut. You have the right to remain silent, remember?

My Son & I were stopped at one of these checkpoints tonight. They asked, "You had anything to drink tonight?, etc." They then asked for license & proof of insurance & then they wanted to know who's bicycle was in the trunk. I started telling them that they were in violation of The Constitution & that they had no probably cause to stop my freedom of movement. I also told the young officer that I'm former law enforcement & familiar with my rights. They moved me thru w/out proof of insurance!

the border patrol in indio know me cause i work out there everyday and I have my scrubs on..They get mad at me because they ask me where i work and i tell them they are violating my 4th amendment right. Always they search my car and claim it was a k-9 alert. Yesterday it was worse..they said dog is too excited..told me to get out of my car..they handcuffed me did illegal patdown,detained me for hour and found nothing in my car as usual. It would have been interesting to see what would have happened if you didn't obey his unlawful command to stop filming. I can understand some people giving in at that point as its up to the individual and their own pocketbook to make that tough judgement to proceed further and to allow the officer to make a false arrest on them.

You are correct, you don't need to provide them with ID at that point, however, it isn't probable cause but only reasonable articulable suspicion that is required for them to "demand" you to identify yourself. Its a lower threshold to satisfy than probable cause. They can "ask" you for ID all they want. Asking and demanding it through force or threat are two different things.

If u accept these checkpoints as legal then u must also accept that individuals are property of the state while driving and then are subject to the will and whim of the state. Yes drinking and driving is bad, but destroying the greatest invention in human history (the constitution) is hundreds of times worse.
Check points are not unconstitutional, we have been using them for years and they have been challenged and those challenges have lost. There are certain guidelines which must be followed, which are not that difficult.

requests and demands are two different things.. asking someone for ID without PC is not a violation. detaining them and demanding it from them is. a cop can REQUEST an id from anyone.

Next time you are pulled over, ask them, "Are you being detained and that they need specific and articulable facts to justify that detainment." Usually that lingo right there will shit them down. Then ask, "Am I free to go." Also, cite WIRETAPPING LAW, which states you have a right to record them while they are out in public.

o it is lawful to pull over someone you believe has done a crime however these checkpoints do not do that...they do not observe drivers that are drunk or erratic you are pulled over just because you are number 5 in the line or whatever number they chose. Randomness is not legal. However these officers and other like it are banking on it that people will not be smart enough to fight it and the ones who usually do are the ones who are guilty of something and the search is overshadowed by crime
However they do not know how to deal with someone who has done nothing wrong questioning them being there and willing to fight it these people are dangerous because they have a true backing from the founding documents and are going to be supported in the court if they fight it...but again they just challange you to fight it knowing the epense it costs for the courts and most people dont have the money or time to fight it
The thing is if a police officer is alone on the road or even with a second officer in their own car and they notice someone driving erratic then it is lawful to pull them over search the vehicle and so fourth as long as the charge or the belief that the charge warrants a search via probable cause (DUI belief seach the car for open containers) However it is unlawful to pull someone over for a taillight or cracked winshield and then demand to search the vehicle because the charge doesnt warrant

Can't anyone dispute a ticket received at a DUI checkpoint and get it dismissed? I'm sure they can but what stops these assholes from doing this. The scope of the checkpoint is to check sobriety. That's it. Once they determine if a suspect is not drunk, it's over. They have no legal right to detain that person any longer. Any evidence gained after that can be suppressed in court and would be inadmissible. But they don't care. We need some type of recourse so they can't continue this.

This statement is false. There is no requirement to ID just because some officer asks you to. He must first have reasonable suspicion of criminal activity and you are involved with that activity. Also, states must have enabling legislation in effect. Identification can be given verbally.

They asked, "You had anything to drink tonight?, etc." They then asked for license & proof of insurance & then they wanted to know who's bicycle was in the trunk. I started telling them that they were in violation of The Constitution & that they had no probably cause to stop my freedom of movement. I also told the young officer that I'm former law enforcement & familiar with my rights. They moved me thru w/out proof of insurance!

You are correct, you don't need to provide them with ID at that point, however, it isn't probable cause but only reasonable articulable suspicion that is required for them to "demand" you to identify yourself. Its a lower threshold to satisfy than probable cause. They can "ask" you for ID all they want. Asking and demanding it through force or threat are two different things.

@mrjustin5 This video is a joke, if you had real passion and knew the law, you would have stood your ground and been willing to go to jail. You should have also been ready for this situation by having a secondary person with a camera to document the situation. All I see here is a guy trying to make a point, but you end up looking like a pussy. You don't even ask the basic questions or assert your rights. Instead you drop the camera down like a little scolded child instead of standing your ground

Man lots of folks commenting on here supporting the checkpoints. Thats not good at all. If u accept these checkpoints as legal then u must also accept that individuals are property of the state while driving and then are subject to the will and whim of the state. Yes drinking and driving is bad, but destroying the greatest invention in human history (the constitution) is hundreds of times worse.

Check points are not unconstitutional, we have been using them for years and they have been challenged and those challenges have lost. There are certain guidelines which must be followed, which are not that difficult.
This guy should go back to school or read up on the case law.
As for him photographing and being forced to turn off the camera? He was never ordered to turn it off, so he did so voluntarily.

They even say "we will make a deal, we will be lenient on you, we wont bust you for [this or that] if you just tell us [something] in return." etc etc. Its an absolute fact that police cannot strike deals. Only the District Attorney can do that.

@mrjustin5 The best way to tell if they are lying is to ask them if they will state whatever they are saying under the penalties of perjury. If they say no, then chances are they are lying. If you want to know more about when police cannot lie, search your state's criminal statutes regarding fraud.

Cops actually have a dramatically lower life expectancy than the average person, and it's not because of the so-called "danger" of their "job". I have no empathy for that anyway, they CHOOSE IT! Those who die earlier probably got cancer or something else ate them up.

requests and demands are two different things.. asking someone for ID without PC is not a violation. detaining them and demanding it from them is. a cop can REQUEST an id from anyone.

@ItsFatSantaa The police lie to you all the time. I had 3 different cops tell me that it is "California Law" to have some sort of ID on you AT ALL TIMES even walking down the street. Of course, there IS NO SUCH LAW. Why don't YOU go out and video the police BY YOURSELF, at night, in front of all these cops. Why don't YOU try asserting your constitutional rights such as freedom of speech and forth amendment. Lets see how well you do. Make your own video, please. I will be waiting for it.

Actually, if you had watched the Discovery and History Channels, you would have realized that people have utilized those camcorder cameras as weapons in the past; especially because they provide the murderer with a trigger mechanism and a sight for aiming.

I dont see anything unconstitutional with setting up a checkpoint which takes out of the streets people that are driving under the influence endangering the lives of innocent people. I bet that if anyone in your family was killed by a drunk driver you would not be videotapping. But hey, you have the right to be ignorant!!!

@fxb44 You don't see anything unconstitutional? How about the constitution itself, have you seen that? If you had, you'd see that this is a violation of the 4th AND 5th ammendments. In layman's terms, police can't search your shit or make you talk. However good the intentions are, it does NOT change the fact that it's unconstitutional. I guaruntee that if police were to search everyone's home on a given street block, they'd find something illegal. That doesn't make it okay to hurt the innocent.

@mrjustin5 Check out checkpoint USA. A true American patriot. He deals with border patrol and US Customs, but his points apply to domestic cops as well. Next time you are pulled over, ask them, "Are you being detained and that they need specific and articulable facts to justify that detainment." Usually that lingo right there will shit them down. Then ask, "Am I free to go." Also, cite WIRETAPPING LAW, which states you have a right to record them while they are out in public.

o it is lawful to pull over someone you believe has done a crime however these checkpoints do not do that...they do not observe drivers that are drunk or erratic you are pulled over just because you are number 5 in the line or whatever number they chose. Randomness is not legal. However these officers and other like it are banking on it that people will not be smart enough to fight it and the ones who usually do are the ones who are guilty of something and the search is overshadowed by crime

However they do not know how to deal with someone who has done nothing wrong questioning them being there and willing to fight it these people are dangerous because they have a true backing from the founding documents and are going to be supported in the court if they fight it...but again they just challange you to fight it knowing the epense it costs for the courts and most people dont have the money or time to fight it

The thing is if a police officer is alone on the road or even with a second officer in their own car and they notice someone driving erratic then it is lawful to pull them over search the vehicle and so fourth as long as the charge or the belief that the charge warrants a search via probable cause (DUI belief seach the car for open containers) However it is unlawful to pull someone over for a taillight or cracked winshield and then demand to search the vehicle because the charge doesnt warrant
