Important tip: After the officer says "Can I search your vehicle?" and you say "no" then you need to ask "I want to leave. Am I free to go sir?" If the cop decides to detain you after asking that question he has justify the reason for detaining you.
If the cop calls in a search dog, again he has to justify the reason for detaining you after the traffic ticket was issued and you asked to leave. Most likely he won't be able to and the dog sniff will be excluded from evidence.
First, when you turn in your fellow officer for wrong doing you literally place yourself on an island isolated from any and all help. Second, bad cops get away with crap because the DA backs them up. It's just the way it is and it's only getting worse.
The Supreme Court has ruled on pretextual traffic stops. The police cannot use the fact that you deny them a search as probable cause, they try to use it as reasonable suspicion, but in court in a criminal case, its good enough to exclude the evidence.
Its tricky because most of the time if you deny them the right to search your car they can say that they can in fact use that as a pretex to search your car because they feel as though you are hiding something or acting "suspicious", because you are not "cooperating".

I am of the school that no occupation deserves praise simply by virtue of their occupation. You have to do something to warrant merit. If a cop asks you where you are going/where you're headed simply state the direction in which you are traveling. If you are going North on I-95 then you say "Oh, I'm just headed North on I-95." Thank God for videos like this. It's helped me to educate myself better. You know, I hate to admit it. Looking back, my education really failed me on the constitution. We were never taught exactly WHAT to do in a situation like this. In my past, I've consented to searches because, I felt, only a guilty person has something to hide. But I'm pretty sure the trooper realized had no "probable cause" to search his truck. That's why he asked for permission to search. When I was in driving school (long ago) the state trooper told us that we HAD the right to refuse consent to search the car, but just refusing consent automatically gave them probably cause. I thought it was a weird Catch-22. Was he just trying to scare some 15 yr olds or is that true? Another question I have...I often hear cops saying "where were you coming from" &/or "where are you heading?", etc. I know the idea behind this is to try to get you to trip up on something you said. How does one refute these questions without being revealing OR belligerent?
@progmusicman17 You can always refuse field sobriety test, but you cannot refuse chemical tests such as Breathalyzer or blood test or urine, in fact, I would not blow in those machines on the side of the road either make sure it is a tested unit.
It is none of the police's business where you came from or going etc. You can always tell the cop, "my lawyer has advised me that I should not answer those kinds of questions without him/her present".
@flacan2000 You can refuse all tests unless you are in a serious accident. You own your blood and urine and if a cop wants a sample he is going to have to pay me a lot of money for it or he is not going to get it. State statutes govern what happens when one refuses these tests. In Pennsylvania they bring into court the fact that you refused. They will try to spin it as proof you were intoxicated but if you know the law they cannot win. All the refusal can prove is that you refused!
@progmusicman17 From what I understand you can deny a field test but not one if they take you into the station. If they arrest you they will give you a sobriety test at jail but you don't have to do one in public/in the field. Can anyone confirm this?

@progmusicman17 I was pulled over and falsly accused of driving drunk without a drop of alcohol consumed for the past couple of months. The two responding officers wanted me to do a roadside sobriety test. I don't have the best balance naturally so I refused and told them i would fail because of my minor balance problem. They then tried to arrest me for drining drunk, but I tiold them I knew my Rights, and I was allowed a Breathalyzer test. They gave it to me, 0.00%, and they let me go.
@progmusicman17 You can refuse, under the 5th amendment, ANY field sobriety test. You are not required to provide evidence against yourself, as that constitutes self-incrimination. That includes the field breathalyzer. If, however, you are arrested, and refuse the blood tests and breathalyzer tests, you can lose your license, but it's much easier to appeal.

Important tip: After the officer says "Can I search your vehicle?" and you say "no" then you need to ask "I want to leave. Am I free to go sir?" If the cop decides to detain you after asking that question he has justify the reason for detaining you.
If the cop calls in a search dog, again he has to justify the reason for detaining you after the traffic ticket was issued and you asked to leave. Most likely he won't be able to and the dog sniff will be excluded from evidence.

The Supreme Court has ruled on pretextual traffic stops. The police cannot use the fact that you deny them a search as probable cause, they try to use it as reasonable suspicion, but in court in a criminal case, its good enough to exclude the evidence.

@saknk1 That may be true, but there have also been times that regular citizens have saved others in these conditions. I am of the school that no occupation deserves praise simply by virtue of their occupation. You have to do something to warrant merit. In fact cops should be held to a higher standard per they are supposed to be examples unfortunately due to the attitude of lumping praise upon them warranted or not, police seem to have developed a superiority complex, which is a shame.

The majority of police officers place their lives in the path of danger on a daily basis, you don't ask them to, but they do it. Sure it's their job to place themselves in mortal danger because they signed up for it. But the willingness to do so earns them some shred of respect, wouldn't you feel as if you could respect someone who would go out of their way to do something for you?

5:36 -Note: The police can only legally pat you down if they have a bases for suspecting that you're armed and if they are detaining you or get permission that they may pat you down - And they can only detain you if they have reasonable suspicion (I.E: Matching the description of a criminal suspect, dropping something, running from the cops, etc.).
Also, it's illegal for an officer to pat you down for drugs. And you could also ask: "Are you detaining me, or am I free to go?" to end it quicker.

Unlike what cop haters say, this is how most cops act when the driver isn't an asshole towards them, follows some simple directions ie hand over your license etc. and answers questions in a straight forward way. The only question I don't answer honestly is "Do you know why I stopped you?" Only an idiot says "Yes, I was speeding." If you have nothing to hide, you have nothing to fear. Unless the cop is one of the few who enjoy hassling Joe Public.

If the cop had actually seen anything thrown out, he'd know that it would be on his dashcam, and that would have provided probable cause for a search. He was lying about seeing something thrown out of the vehicle. Cops lie a lot; it's not a character defect - it's how they deal with criminals. But it's good for people to know that cops lie and are trained to get consent in any way possible. By the way - the part of the tape after the ticket was written was an illegal detention.

We were never taught exactly WHAT to do in a situation like this. In my past, I've consented to searches because, I felt, only a guilty person has something to hide. But I'm pretty sure the trooper realized had no "probable cause" to search his truck. That's why he asked for permission to search. his so called probable cause to search was to say he saw the driver throw something out of the window.. had he been black(driver) even after being refused consent,he(the officer) would have called for the k9 unit and they would've pretended that the dog alerted on narcotics.. either way they would've been in that vehicle for a search.. nothing found,guess what they say,there's been some drugs in that car recently.. thats what they always say.find something ,you get locked up.

@bossvks that may all be true, but if you refuse a search and roll up the windows and lock the doors before getting out the dog can't even go inside and there are ways in court to question the signal of the dog, but refusing a search and if the cops do search and do find, you may be able to get the evidence suppressed, even if jailed.

@bossvks your right as rain , in tn if you refuse a police search of your home or car GUESS WHAT your going to jail for resisting its the oldest scam that cops use and then your going to get your car or home searched anyway .always remember cops get there way and 9 out 10 times its the wrong way. tn cops are the worst in the nation for abusing peoples rights they really believe the only rights you have are the ones they give you , any tn judge will tell you YOU HAVE NO RIGHTS IN THERE COURTROOM

If stopped answer ONLY the questions asked and don't volunteer your freakin' life story.
Have the paperwork where it can easily be reached and only give them what they ask for.
If you are stopped for a 'legitimate' offense please remember YOU started the process.
Keep it professional and normally you will be back on the road sooner.
I have escaped dozens of tickets just by keeping quiet and being polite.
And remember:
A Cop has to prove to a Judge that he had PC.
Most won't bother.

When I was in driving school (long ago) the state trooper told us that we HAD the right to refuse consent to search the car, but just refusing consent automatically gave them probably cause. I thought it was a weird Catch-22. Was he just trying to scare some 15 yr olds or is that true? I'm worried because sometimes my brother and I share a car and my brother has gotten in trouble with cops finding pot in the car. I don't want to get in trouble for something my dumbass brother did.

Ohio, 392 U.S. 1 (1968)) Courts have ruled However, reasonable suspicion may not apply merely because a person refuses to answer questions, declines to allow a voluntary search, or is of a suspected race or ethnicity.

You have the right to refuse a search.. and they HAVE to abide by it... But... they can call for a K-9 unit and sniff out your car.... And if the dog catches a scent, it's probable cause. Even if it's because you had drugs there at one point, but not at the moment, they can search your car after that.

Clearly he had no probable cause-most state courts have said "why you looking in his glove compartment when you pulled him over for speeding; do you think you'll find more evidence of speeding there?"

A traffic stop doesn't have to evolve into a violation of civil rights, They can differentiate when and where to do that and wouldn't do that on camera with a microphone recording over a little weed. Even still its their word against yours.
But they can turn a traffic stop into a big joke, and make you piss your pants a little bit.

That's why he pretended to make a call. This deputy was ready to get in his car and you chose to run your lips, truth be told, cops ordinarily have a pretty dull day.

If the cop were really That aware and thought you had drugs, he would've called for backup from jump. Secondly, when the cop issued the citation, the stop WAS over jackass, he was fucking with you, he unlike you, knows the law, and was going to let you go.
He also knew he wasn't about to possibly make a day of paperwork over a speeding ticket for a joint, why try a fry a fish who couldn't afford "5 pounds" if he lived to be 80 by the way he looked.

"They wanted to do a field sobriety test. I refused..." If you refuse, don't you automatically lose you license? I assume you did some kind of breathalizer or something?
Another question I have...I often hear cops saying "where were you coming from" &/or "where are you heading?", etc. I know the idea behind this is to try to get you to trip up on something you said. How does one refute these questions without being revealing OR belligerent?

@progmusicman17 You can always refuse field sobriety test, but you cannot refuse chemical tests such as Breathalyzer or blood test or urine, in fact, I would not blow in those machines on the side of the road either make sure it is a tested unit.
It is none of the police's business where you came from or going etc. You can always tell the cop, "my lawyer has advised me that I should not answer those kinds of questions without him/her present".

@flacan2000 You can refuse all tests unless you are in a serious accident. You own your blood and urine and if a cop wants a sample he is going to have to pay me a lot of money for it or he is not going to get it. State statutes govern what happens when one refuses these tests. In Pennsylvania they bring into court the fact that you refused. They will try to spin it as proof you were intoxicated but if you know the law they cannot win. All the refusal can prove is that you refused!

@progmusicman17 From what I understand you can deny a field test but not one if they take you into the station. If they arrest you they will give you a sobriety test at jail but you don't have to do one in public/in the field. Can anyone confirm this?
And you can just say that you are uncomfortable answering any questions. you have the "right to remain silent" lol

@progmusicman17 I was pulled over and falsly accused of driving drunk without a drop of alcohol consumed for the past couple of months. The two responding officers wanted me to do a roadside sobriety test. I don't have the best balance naturally so I refused and told them i would fail because of my minor balance problem. They then tried to arrest me for drining drunk, but I tiold them I knew my Rights, and I was allowed a Breathalyzer test. They gave it to me, 0.00%, and they let me go.

@progmusicman17 You can refuse, under the 5th amendment, ANY field sobriety test. You are not required to provide evidence against yourself, as that constitutes self-incrimination. That includes the field breathalyzer. If, however, you are arrested, and refuse the blood tests and breathalyzer tests, you can lose your license, but it's much easier to appeal.
Smarten up. Lawyer up and make them work for it.

A polite but confident, "Are you detaining me, or am I free to go?" will show him you understand how things work. If he is detaining you, REALLY shut
