you can, but you need to flash a new rom to your touch pro which will void your warranty

No it does not void your warranty. All you have to do it flash back to your original stock ROM before turning in phone. I even know of someone sending TP2 back with new ROM and Sprint did not charge for the replacment for hardware problem. Usually warranty issues are exchanged for hardware problems so you can easily flash to stock ROM b4 sending back.
