Van driver was basically right in this case. You should have stayed within the bicycle lane.
Appeared to be only a couple of minor obstructions (potholes or manhole covers) along the bicycle lane. But there seemed to be a (narrow) way to cycle between the obstructions. Or, you could have veered out of the bicycle path briefly to avoid the obstructions, after checking for following vehicles first, of course.
No justification for cycling mostly out of the bicycle lane in this case.
@brispuss There are no laws stating a cyclist must remain within the boundaries of a cycle lane, we are well within our rights to take to the main traffic lanes. Cycle lanes are dangerous and put cyclists on the inside of HGV's and directly in the door zone, I never use them, nor do many cycle commuters.
The van driver's actions were not justified as the cyclist has no obligation to remain in the cycle lane, they are purely there as an element to stop cars stopping too far left.
@smith34n Yes and no. I'm a cyclist also. In this particular case, there was no immediate danger to Mags if he had cycled within the cycle lane. If there are no obstructions and/or no potentially dangerous circumstances to the cyclist, then out of courtesy, the cyclist should cycle to the left as far as possible, to allow faster vehicular traffic the opportunity to pass and minimize disruption to traffic flow and therefore improve cyclist/driver relations.

The road was wide as you said, so why didn't Mags cycle to more to the left to allow (more) space for the vehicle? As far as I could tell, the only (slight) hazard to cyclists may have been the "patch work" highlighted in the video. What little water there was in the cycle lane was concentrated beside the kerb, cyclists could still use the cycle lane and be clear of the water.

Magnatom avoided those potholes to the side of the cycle lane, otherwise his camera would have shook and we would see that on the video. Besides, the road was wet and so he was wise to avoid the painted surface of the cycle lane. Use of cycle lanes is not mandatory, check your highway code.

Further to that there is no obligation to use cycle paths and both the AA and the Institute of Advanced Motorists (as well as others) advise cyclists to ride 1.5 - 2 metres away from the curb, known as vehicular cycling. In many cases cycle paths place riders in dangerous positions. Cyclists have a right to the road the same as any other vehicle.

Surely if you use the same routes regularly you could attempt to remember where the pot holes are in the cycle lane, like the rest of us do (both when driving and riding) .

Having seen all these comments from both side. Th argument of get into the cycling lane is valid if the driving lanes narrow. Because it all about courtesy of other road users. However in this case I think the driver had too much chilli before hand and decides to shout even if he needn't to. How hard is it stay a little further right like the rest of the motorists?

Magnatom avoided those potholes to the side of the cycle lane, otherwise his camera would have shook and we would see that on the video. Besides, the road was wet and so he was wise to avoid the painted surface of the cycle lane. Use of cycle lanes is not mandatory, check your highway code.

@kmcyc I live in a city in the U.S. where you have to use the bike lane when it is available. He had PLENTY of time to get into the bike lane he was in after he avoided the potholes.

I've cycled in America and other countries too. As with driving abroad you should apply the local laws. Here, cyclists are not required to use cycle lanes, they are all optional, which allows the cyclist to ride where they feel the safest. After all, it's not the car driver who will end up in hospital now is it?

You were not weaving and you do not have to use the cycle lane. They cause a lot of aggression. I think you were in the right position. The cycle lane also goes passed a junction, close to the give way markings (as they always seem to do ) What can we do if the road engineers put this stuff down. I have heard that these days the guys that design our roads have to have cycle training to level 3, is this true. If it were they would be busy redoing all their old work.

I think the driver had a point; you were weaving around in the road and despite the mention early in the clip that you were using the cycle lane, you thereafter decided not to use it which you'll probably say was because of pot holes etc, but there were some fucking great big pot holes where you were cycling anyway. The driver was right and yes you are a twat.

@MrMentalProblems This is an intriguing comment considering I saw no weaving in this video. Further to that there is no obligation to use cycle paths and both the AA and the Institute of Advanced Motorists (as well as others) advise cyclists to ride 1.5 - 2 metres away from the curb, known as vehicular cycling. In many cases cycle paths place riders in dangerous positions. Cyclists have a right to the road the same as any other vehicle.
