  • When I was buried in debt, the dumb ass collectors would call at 8:00 pm and ask if I had the money. Then, they would call back at 8:05 and ask again. I could certainly understand them calling me because I DID owe the money. But, why turn around and call back 5 minutes later? I mean, what the hell could have possibly changed in 5 damn minutes? I eventually got all my debts paid off and am done with collectors. If I never hear from a collector again, it'll still be way too soon!

  • why are people trying to get out of paying their debt. muy father taught me to never have debt. and now i feel stupid as I see that everyone tries to put off or get out of their obligations and I end up haveing to pay for it through taxes and higher cost on everything. if you feel guilty you ARE GUILTY. do not buy or barrow live within your means other people do. why do you get away with it?

But if you are struggling and falling behind, you don't deserve to be harassed and threatened by these pricks if you're being honest and trying to work something out with them until you get back on your feet. You certainly don't deserve to be lied to, or called at work when you've requested not to be. I do share you sentiment though, if you own them money, you need to be working on how to pay them back.

  • How about if debt collectors call you all the time asking for the wrong person, someone who you don't even know and have no idea what they are talking about. Those are the calls that bug me.....

  • I had a debt collector call me a few minutes past 9pm one night. They called 3 times in a row and I finally answered the phone and told them it was late. I told them not to call me again but they continued calling for weeks after that. They also threatened me with legal action and used insults, telling me I was worthless (or something to that effect) for not making good on my debt. If I could, I would. Simple as that. I don't exactly enjoy being harassed for money.

  • @imparfaite I hear you !!! I had one from India and they told me to have my 6 yr old daughter go out and give BJ's for money to pay my bill. There are some really sick people out there!!! I sued and the guy was put in prison and I won alittle bit of money.

  • I used to be in collections. The FDCPA is out of date and needs to be updated. First off the law says no personal info can be disclosed to a 3rd party, which means that a 19 year old kid's mom cannot be told about the debt even though she might be in a position to pay it off. Next because of privacy issues the law states ID must be verified over the phone with the debtor providing the info except people are so paranoid they won't do it because of ID theft and obviously who can blame them?

  • You guys shouldn't mislead the public like this. You should disclose that the FDCPA only applies to third party collections. If the collections is first party none of these rules apply, and all of you know this but don't disclose the information.

  • im a collector and i dont do any of this. and the only way you can get the calls to stop is to send in a cease and desist letter to the agency, or if you have power of attorney. maybe you should know YOUR stuff

  • @Folter Uh yet you still break the law? My family is currently going through bankruptcy, in the 1 month it was happening, they called before 8am 46 times, after 9pm 71 times. They threatened my family with foreclosure, something they can't do. And after we had told them we had acquired an attorney and gave them the number they continued to harass us. Now even if you follow the law, I can guarantee more then 80% of collectors break the law and no one does anything cause they are threatened.

  • @bvsandman not every office is a bad one. our office follows the FDCPA stringently, and we try to actually work with people as opposed to backing them in a corner. everything u stated i completely agree with on the fact that those things are illegal. however there are smarter ways to go about it. they verify poa and contact with you is prohibited unless info is incorrect, and even if you want the contact to stop, the cease and desist letter should take care of that.

  • @bvsandman if u still get calls they are then breaking the law and you can contact the attorney generals office for that. if u want the calls to stop FDCPA states you need to send written confirmation that you do not want to be contacted anymore. that makes the second way in this video not entirely true

  • I am a judgment collections agent. When I get the judgment paid off I send a court form called satisfaction of judgment to the credit bureaus, and tell them that is going to help their credit as well.   • heh.. well of course we've fallen prey to this, because these laws where only recently passed. the "common" person doesnt have the time to sit and look over every new law. this is how the elitist stay in power and in money. yet its still happening. feverishly so i might add. like i wrote in reply...think on this..you have bad credit , you try to get a job, you cant get the job, because of your bad credit.. so how are you suppose to get out of it? its a cycle they created to keep the poor, poor.

  • Over the years I have seen numerous companies in the office building where I work, who were supposedly "practicing" debt collection. All of those people were just some street "scums" and not any kind of lawyers what-so-ever. Nor did they have a sufficient education to properly sue you if they could. All of them were using fear tactics to scare the hell out of people to get the money and they did just that, although not very efficiently, because most of them have went out of business! Fight them!

  • Debt collectors should have to follow the rules that telemarketers have to follow (such as a verbal request being all tht is needed to stop them from calling, rather than a written, certified request, etc.). After all, debt collectors are just telemarketers that can legally practice extortion.

But for further thoughts..think on this...if you have bad credit..and trying to get a job, the employer can and most likely will deny you employment..that means...bad credit = no job = forever in debt. yet no one has noticed this "recycling" sign...

If you state in writing that you don't believe that YOU owe anything at all to THEM, then they would be responsible to prove you otherwise, that in-fact a) you DO owe something and b) that the amount you owe is what they claim it is. Failing for them to do so AFTER you request is ILLEGAL per the FDCPA law and you in-fact have a full right to sue THEM for unfair practices of the law above and actually get money from them through the court. Fight them!

  • So am I to understand that people /dont/ owe the company -who didnt know them from Jack Off Jill- the money they lent in good faith under the borrower's word that they'd be paid back? If you're not worth your word - you should die. The agreement isnt "pay back whenever i can" the agreement is "x months with x dollars on x day." Same goes for school loans. A stranger gave you $50,000.00 that means the people that KNOW the borrower wouldnt give them a dime. Pay your fuckin bills.

  • @tfergusonc What if someone loses their job in a recession? What if someone has an accident/injury/illness preventing them from working? It's a two-way street, things happen in life. But it's a debtor's responsibility to try to work out arrangements with a creditor before it goes to collections.

  • Man most of these had all ready been broken with my case, they come to my home at 4:30 5:00 in the morning and 10:00 at night banging on the door,and I mean it banging. Calling my phone saying they are federal agents they even found out my cell phone number, they follow me all over (hired Investigators) not kidding ether.

    And the thing is this case has nothing to do with me it's my deceased father.

    I have this one debt collector who call every week after I game them are Attorneys number.

  • I'm a new debt collector and learning the ropes. I like how people buy things and dont pay for them and get mad when someone like me asks them to pay for what they took. I mean, after all if you take something that doesn't belong to you it is stealing. So I think people who refuse to pay their debt in a timely matter that are capable of should be charged with theft.

  • @clinteastwoodcowb0y No dice. The reason that credit cards charge higher interest rates is that they face the risk of nonpayment. This is the business that they've chosen to enter, and the rules have been that way for over a century. The creditors can get out of the business at any time they choose if the rules aren't to their liking.

    As for the debt collectors... The minute a debt is bought and/or sold it becomes a commodity, and as such the buyer assumes all risk.

  • Just got off the phone with a debt collector who refused to send me any info of who or what company he was with. He wouldn't even send me info on the debt....strange. Then he called me a criminal after I refused to pay because he wouldn't give me info lol

  • I had a bunch of collection agencies calling my house once looking for my father who owed. I told them repeatedly to stop calling here because he literally did not live here anymore. They kept calling and they would try sneak stuff like calling me by my dad's name when I picked up. I finally just changed the number but man, they were horrible people. They serve no purpose.

  • cost me 1200 to file ch 7 i did it in jan 06 by nov i bought a car with low intrest and payments, and this year i got a mortgage with a low intrest rate sounds to me like it didnt hurt me for the rest of my life.

  • Debt collectors live & work in sewage. Had one dummy call me trying to reach my 24-year old daughter who lives 1200 miles away from me. The debt-collector said she couldn't reach her so I was responsible for her debt because I was her father & they will now expect payment from me immediately! Her attempt at intimidation made me laugh out loud. I called her a liar & told her she just committed fraud. Told her if she calls ever again I call the state Attorney General. Next day she called again.

  • Some people are ill and are unable to pay their bills. Stress can make some illness worse. and no doctor will see them. So the end up in the ER and with more debt.   • Re: Joey only half truth. Generally it's put in writing it's called limited communication or cease and desist. What you're probably talking about is the ones that say "don't call me on the phone" which more likely isn0t going to stop the calls.

  • Some of the information is true some of it is not true or answered very vaguely, e.g. people normally say that they have an attorney but don't pay the attorney, until you have a case # (which means you retained and paid the attorney) you will still get calls, there are other pieces that aren't correct either. FDCPA is strictly for only 3rd party collection agencies.

  • I do not know who made this video, but they are very wrong. First of all, if it was illegal for collectors to continue to call just because someone SAID dont call me, they would all be out of a job. The debtor must write a letter stating very clearly that they are to cease and desist communication. They can continue to report to the debtors credit that its still delinquent, and can actually be contacted by mail again to prove the cease and desist was received. I worked as a collector for 3 yrs

  • I agree... I've reported this video to the American Collectors Association. This company is giving legal advice that is not totally correct. Research the Fair Debt Collection Practices Act (FDCPA) before wasting your time on this video!
