Prof. Sedler's "study" is partisan nonsense. He claims that the MSC literally set a record by overruling 38 cases between 1999 and 2008. Had he done any research at all, he would have seen that, for example, the Montana Supreme Court overruled 109 cases from 1991 to 2000. See Jeffrey T. Renz, Stare Decsis In Montana, 65 Mont. L. Rev. 41, 53 (2004). And that's just what you can discover with 10 minutes on Westlaw. Sedler's article isn't scholarship. It's a political hack job.
