I disagree. i have one of the guitars he smashed during the Rock The Nation tour. Fully functional, but a lower end silvertone guitar. If you watch the Rock the Nation DVD, you can see him make the exchange for the lower end one before he smashes it.

Ok for all you kids too young to know better, guitar smashing started with Pete Townsend of The Who. Paul has smashed guitars since the beginning and, yes they are real.  He throws them out to the audience.

I dont think KISS throws out the broken guitar here im U.S. after a lawsuit where a girl almost got her fingers cut off fighting for a piece

actually yes he did. The early years of KISS saw Paul smash up Les Paul Jrs. I did some searching and found that the LPJs cost about 100$ new back in the 50's so they were probably easy to pick up in pawnshops on the cheap. the cut on the back of the neck is a relief cut to make it easier to smash quick. I saw 'em in '82 on Creatures tour @ it took Paul a few xtra whacks at it but back then he was still using the LPJs not the Ibanez cheapies. cheap or not ..yeah a waste..but then IT"S ROCKNROLL!

Notice that the guitars he breaks now don't have any strings on them... If you go to thesmokinggun dot com you'll see that kiss was sued several years back because Paul threw a "broken" guitar into the crowd like he always does, and a girl caught it, but then 2 assholes grabbed it too, started a tug-of-war, tangling her hand in the strings. They nearly tore her finger off. She sued the band and won.
