  • Johnny Lin Walker was tried in a civilian this is correct.The difference with KSM is he is not an American citizen,he is an enemy combatant, the blood of thousands of Americans on his hands.(many more if he had his way)The 5th and 6th amendments to the Constution applies to American citizens( miranda rights,against self incrimination, as well as trial by jury,speedy trial) trying the shoe bomber and Massoui in civilian court was also wrong, Padilla, like Walker, was an american citizen

    That distinction belongs to John Walker Lindh who was caught in Afghanistan and tried in federal court. U.S. v. Lindh, 227 F.Supp.2d 565

    So the idea that 9-11 changed things was ignored by the Bush administration.

  • Wow, I didn't know that. I still stick with what I said. Despite how Bush classified the man, he was fighting the U.S.A in armed combat and was captured on the battlefield. He swore an oath to Taliban and was trained by Al Qaeda. That to me is an enemy combatant.

    What do you think about the broader point though that Lindh, Mauossoui and Padilla were all similar tried in federal court under Bush and no one batted an eye.

  • Let's not forget that 9/11 did change some things. This is a good explanation.
