Time is short. I truly believe that a false flag action, assassination, or some other unholy event is about to happen again. That will be the excuss needed to disarm the registered public, arrest dissenting voices of what use to be unConstitutional acts, or anything else they choose to do. One day without civil liberties against a corrupt government is one day too many. The internet is one of very few places to learn what is really happening and to spread the word. Remember Hitler's Big Lie.
Why would this government keep habeus corpus dead? They have a script to follow and it's going to involve the concentration camps under construction within what use to be my country. By killing habeus corpus, we the lower classes that get in the way of unbridled power, are setting ducks. Many military and paramilitary, void of any unity to country but power will make the 4:00 am visits like Hitlers SS. Not paranoia, truth. Investigate and write your lazy Congressmen and Senators. SOON!!!
@MoralRapist apathetic stoners: sitting infront of their computers instead of voting for - insert any politician other than George Bush here - since 2000.
Great commentary! It is our duty to take back the republic. People must empower themselves at their state levels. I do believe that it is still not too late but we must act now.
ya so where is habeus corpus under the new guy you love so much...looks like its still dead... and how did the withdrawl from iraq go...oh wait we're still there... he annouces a withdrawl and media men like you get in front of the camera and talk about afghanistan everyday and everyone forgets THAT WE ARE
STILL IN IRAQ... despite the annouced withdrawl his first month in office they just stopped talking about it and BAM! ...like it never happend and we aren't STILL IN IRAQ
The Constitution is the Paradigm. Our Constitution is not designed to be efficient. When Congress declares War then things are different. READ THE CONSITUTION. NO BILL OF ATTAINDERS.
Article 1, Section 9, Clause 2 - "The Privilege of Habeas Corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."
Article 10 - "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
The Unitied States government was not granted the power to suspend the Great Writ by the Constituion.
This is really scary since the president cannot legally eliminate a constitutional article. This country is full of uneducated and uninitiated sheep. Those who understand the law are in prison. Pathetic. Oberman is great for covering this.
And yet this violation of the law has no relation to illegal immigration. Your xenophobia may be justified, but this has ABSOLUTELY NOTHING to do with it.
"The power of the Executive to cast a man in prison without formulating any charge known to the law, and particularly to deny him the judgment of his peers is in the highest degree odious and is the foundation of all totalitarian government, whether Nazi or Communist."
Does anybody know where I can get a copy of the picture of Jon Stewart sodomizing Kaith Olberman who's holding up a picture of Bill O'Reilly and masturbating to it? I want to make a poster of it and give it to my gay newphew who loves Olberman, thinks he's a real hunk.
So mlv123, you have no problem with losing all your rights if the President says so? I wouldn't doubt it if we all were required to beging bowing down to the "President" by next year. Heck, Bush Jr. now has the power to keep himself in Presidency forever, "All Hail The King"...
Also, gorsan, both you & Olberman are incorrect about the bill's habeas corpus provisions. Theyu do not apply to US citizens. Here's a cut & paste lift: "No court, justice, or judge shall have jurisdiction to hear or consider an application for a writ of habeas corpus filed by or on behalf of an alien detained by the United States who has been determined by the United States to have been properly detained as an enemy combatant"
mlv123. The writ of habeas corpus has been around for EIGHT HUNDRED YEARS... never REVOKED in its entirety.. not ONCE... until NOW. It doesn't matter to WHOM what matters is the term "alien/ enemy combatant" can apply to ANYONE and thus the jurisdiction of MCA2006 can apply to them. THAT is the danger!
gorsan, Padilla was arrested years ago. His treatment was obvioiusly not based on The Military Commissions Act of 2006 bill; a law which was passed this month.
Uh, mlv123, you need to read the bill. It applies to anyone the president deems an 'enemy combatant', including US citizens. Not convinced? Ever hear of Jose Padilla - US CITIZEN held for 3.5 years without charges.
Uh, Keith, not only did you not notice that the habeas corpus portions of the bill only apply to aliens; not US citizens; but you dated the Constitution as the 4th of July. That was the Declaration of Independence. Hmm, maybe time for you to go back to being a baseball broadcaster.
Fact is the bill of rights protects the right of the PEOPLE not special people living in the US. We are supposed to BELIEVE in what we preach. Second, the declaration of independence states that ALL men are created equal not some more equal than others again cause they are US citizens. Third, even if you are right and you let this happen to people that are none US citizens you can start your clock and be sure that at some point they will find a lame excuse to apply it to a US citizen.
Look at the world map, it is a bit bigger and has a bit more countries than the US. if we give a green light for our executive branch to go mess with any foreigner just because they THINK they are a threat and disrespect them, do you really think this kind of attitude and disrespect to others, in this time of globalization, would make us live better alongside others in the world?
Mazy, our citizens fall under our Constitution. Lawful enemy combatants fall under the Geneva Convention. This law applies to a very small category of persons: Illegal enemy combatants who are non-citizens. Out of the 100,000 plus prisoners, only the 400 or so at GTMO fall into that category.
Again you are going around the subject to make it sound OK. Rights of OUR people? OK Mr Lawyer, yes you are right but you are missing the point. First, I'm showing you that this is bad politics and it does not represent American values. If you believe in human rights then you have to believe in it, period. Oh sorry, you finished the civil war now you want a world war to prove these are ALL PEOPLES rights.
Anyway, if you really feel these acts are justified then good for you. If I were Bush, law or no law, I couldn't sleep at night thinking about the big mess I created out of another mess others created for us.
Second, you have to have enough reason to throw people in GITMO. How would you feel if they took you from the streets in Kabul and threw you in jail for many years without you being able to defend yourself? Even though not proven, there are so many cases against GITMO both in court and in the press.
I just can't believe after all this mess, what should a government do to be considered incompetent and untrusted? To prove that US is heading downwards? Start killing people in the streets and throwing tax dollars from a chopper in the atlantic ocean?
Our government's "drug war" is responsible for 10,000 deaths in our "streets" each year. Prohibition creates TENS OF BILLIONS a year in funding for cartels and organized crime and gangs. We SPEND 70 Billion a year to keep up the drug war that insures their income. And sometimes when the coastguard is hunting them, the cartels throw the result of our tax dollars into the atlantic ocean. We imprison a higher percentage of our non-violent citizens (for lifestyle crimes) than any nation on earth.
First, military commissions and tribunals are as old as George Washington and Abraham Lincoln and as recent as FDR and WWII. No one subject to them had the right of habeas corpus. We have normally treated our prisoners of war humanely, but we have never given constitutional rights to POWs or other enemy combatants. The portions of this bill dealing with habeas corpus apply only to aliens, not to US citizens. Olbermann should have read the bill.
1) military commissions, has been practiced in the past, but it does not make it any more right than persecution of the Jews, which has and continues to be practiced.
2)NOWHERE in that Bill does it say that it cannnot be applied to citizens.
3)If detained as an enemy combatant I want you to pull out your wallet and prove to me you are a citizen. Driver's License, why, didn't you know? Aliens can get those. Do you carry around your Birtch Certificate?
...we have given rights under the Geneva Conventions to POWs, but by calling them Enemy combatants and throwing out the Geneva Conventions we have in fact - gotten rid of any legal authority we had.
how did the SA, a country I once loved so much as my own, end up with an ASSHOLE lilke Bush? I just hope he won't annouce that he can be realected... Cause even Easter-European countries now have MORE liberty then the USA!
Thanks for the comment. What I understood is that a non-citizen or citizen (if found not patriotic) by saying or doing the wrong stuff could end up with no rights at all to a fair trial - actually "what trial" - Olbermann suggests. Am I saying this right?

magog, military commissions are authorized by both our laws and international laws--specifically the Geneva Convention.
