Judge William J. Haynes states that race has been a factor in the constitution since it was formed. During the formation of the constitution, slavery was a hot debated issue. The original constitution stated that slavery could not be abolished in 20 years. There are several stages to the issue of slavery and the constitution. One stage was the amendments to the constitution that gave the freed slaves rights. States had the authority to pass Jim Crow laws.
