Contempt of court is the only remaining common law in Canada. S9. Everything else is under the jurisdiction of the province and provincial statutes. Therefore yes you have your right to travel if you are obeying provincial statues. You are not obeying the speed limit, and the officer has reasonable grounds to give you a breath test, therefore you can't argue your common law stuff. Go to law school buddy and learn a few.
Anyone that can remember this much about his rights when he's drunk, and other legalities, deserves to get off from charges rofl, but he's got a point, the officer hasn't showing ID, Badge, or business card, which by law they have to do if they are in uniform
i love this i have been harassed and bullied by police and people should be more like this guy so the police dont just do as they please as i seen in numerous occasions, dont get me wrong i respect the law and police.
Another idiot ruining the movement. You're driving drunk, which means that you are putting others in danger. Once you do this, the policeman is within his duties to take you away, since you are in a position to break the law by harming someone else. Most statues are just cash grabs, but the drunk driving one is not. Idiot.
Although, by running "their" tags technically the "property" is registered within their roles, hence it is under their jurisdiction.they "technically" see one as being under their employment and governed under all "Their" codes and statutes..Turn in the tags, make your own, and serve notice on them, then they "technically" have no jurisdiction!!
lol what an idiot, "you have no probably suspension to breathalyze me" a second before, "I've has about 2 beers" that is probable suspension, asshole. Also he can detain you for 24 hours. Swearing at a police office is completely under the umbrella of assaulting an officer.
this isnt a real police officer, a real police officer would have bashed this guys head in, beat him with a baton, then tazered him, hell he might have even shot him then deleted the film...police are not your friends people.....they hate you.

I hope they threw the book at this guy...oh PS...if you want to make an ignorant point sound marginally more intelligent, perhaps limiting your use of profanity might help next time
@lainypink Well said, however you might want to look up the meaning of "traffic" in a legal dictionary. Traffic means commerce the highway traffic act actually applies to those engaged in commercial enterprise upon the highway. A driver is someone that is paid to do so. producing a drivers licence means you agree and are engaged in commerce upon the highway it is evidence to that effect.

Do you Freemen people understand that by not providing a breath sample is an offence itself, indictable even. Thus, the Peace Officer can arrest. The PO had reasonable grounds to require a breath sample, he smelled it on his breath and the driver admitted to drinking. Sorry folks, this freemen guy was just saying things to try and save his own ass, most of which made no sense. Stop blindly supporting police hate if you have 0 knowledge of law...which is very evident in these comments....
actually in Canada, the police officer, under suspicion, can demand a sobreity test (physical or breathalyzer) which must be completed (otherwise it's a criminal offence) even before the suspect can talk to a lawyer.
Goddamit this is pure Gold! It should be on every local t.v. station everywhere, make this go viral. Its good, finally the shoe's on the other foot. The police need to know their limits, they think they can abuse, intimidate and use force to get everyone to be their slaves & tax them with tickets. I'm glad he was rude, cops are scum. Where's part 2? Anyone.
If the guys drunk then there's a serious issue there, but that's aside from the common law. Morality and law are two different issues.
@D33Lux No, the law and morality are intertwined. It is through moral condemnation that an act become prohibited.
Bottom line despite all his protest he still ends up locked up. As someone has mentioned showing a licence puts him in the cops jurisdiction. everything he has said becomes evidence against him. There is a protocol to follow which goes a long way to avoid controversy and court. If I were a juror in this case I would vote to convict on this evidence alone.
@MrKilroi He made that condemnation because he failed to keep his composure & with his consent he convicted himself. Morality only plays the part in the individual, people are unethical all the time. He should have keep things simple & stated his position with no further participation. Since he was obviously drunk I have no sympathy for him, but the common laws he stated I agree with. So the best thing to do is not even carry the drivers license. Its not necessary & only convicts you.
7:11 notice what the cop says on his radio... "he doesn't believe in Common Law" clear lie since the guy was claiming and acting under common law all along.
he talks about the magna carta. He is correct in the fact that the Magna Carta applies to all British commonwealth states and is written into the British North America Act of 1867 which still applies today, it's not snubbed out by the 1982 constitution, it's still a valid law today.
he was suspicious of driving impaired...potentially putting the public in danger, as well as exceeding the speed limit...also putting the public in danger...that sounds like a breach of the peace to me! Just blow the breathalyzer!
he was suspicious of driving impaired...potentially putting the public in danger, as well as exceeding the speed limit...also putting the public in danger...that sounds like a breach of the peace to me!
@WilliamTapley dont get the law here, cos its different with in a car than walking, i just past my driving test, and they want me to claim my license i dont know if i need to show ID in a car or not, or if my car has to be registered, or if it can be just "recorded" by sending in letters to head of departments in governemnt, please could you clear this up for me,, but id like to clarify what the police do with no id or license, or no licence but car is registered, or not registered with id etc
@TheFlashlance i agree that you need to stand true for your rights..... but 1) speeding is against the law 2) impaired driving is against the law 3) resist arrest/ obstruction is against the law....... so he's retarded and needs to be taught a lesson
and he's really annoying, Anybody with half a brain can read about common and legislative law and play this game. What we really have here is a drunk driver with an inferiority complex and a bad attitude who thinks he's really clever because he read a few pages on wikipedia about law. If it came to light that 30mins before he was pulled over he had ran over and killed a kid everyone be calling him a villain, not a freeman. just a douch bag
I agree, a lot of the world is backwoods and it is run by corporate villains who want to rob us of all our rights. This police man is a servant of that system and is paid to enforce it. If you don't respect that system or your indifferent then a policeman represents an oppressor who wants you to conform. The guy is obviously passionate about his rights and freedoms and that is commendable but you cant just drive around at any speed you want after a couple of drinks. Serve and "Protect"
He also littered when throwing his cigarette. He was rude, but I do support the action taken we as citizens need to educate ourselves and defend our sovereing right. Law has way to much power especially in the states.
@psychodrilla He was speeding, which IS a crime, the police officer acted exactly as he should, personally I would of kicked that guys teeth down his throat.
@psychodrilla hummm 116 kmh on a 80km/h is an offence. Driving drunk is an offence and also failing to provide a breath sample to an officer upon request is an offence. Where do you guys live... Antartica ?
yeah fuckin great stuff, you people shouldnt defend this dick he was aggressive,he was swearing and he had been drink driving, this is a abuse of his knowledge and in my eyes brings shame on freemen.
the cop was polite and seemed a good guy and like most cops not well briefed, the organ grinder and the monkey springs to mind, dont shoot the messenger!
@MrJrwicked you believe in precrime robbing in the name of safety, your definitely a sheep. ohh dont forget to drink your high doses of dumb down fluoride for the day. keep you ignorant sheep dumbed down.
@MrJrwicked im sure you do, typical sheep, making laws off of a belief, when the facts are, there is NO INJURED PARTY in this incident. go back to your fluoride water, its working well on you and millions of others.
@MrJrwicked FAT LIES: There was a time when there were no Breathelizers and statistics shows that the number of road accident deaths then were lower. Its all about control buddy. Soon people will be making arguments of the kind you make her on the pat down(TSA) scanning in airports. Its got nothing to do with security.
@MrJrwicked having rewatched this a number of times i agree with you comment the cop actually tries to tell this guy he's ok to leave but not with the car,ok he may have wanted it towed but if the guy was thinking straight he'd of been able to get that sorted later
the cop was sound he was a twat
got what he deserved
its called karma in some parts of the world
but he had not been in crime as far as i'm concerned
@psychodrilla I to am a believer in karma. the point i was trying to make was that the guy in the vid could have went about things in a better manner and tried to educate the cop, who like most people are not aware of the bigger picture of what is really going on.
and the main point i was trying to make was that if he had been drinking n smoking weed aswell as speeding he could harm or kill somebody and that would be a crime.
@beteck123 are you stupid? section 215 of the mva (motor vehicle act) allows to impound a vehicle if the person is between .05 and .08 bac (blood alcohol content). also the vehicle is illegally parked so it has to be towed. furthermore, you are an idiot and you need to read the laws before you comment
@MrJrwicked the cop is an ignorant henchman trying to extort the common man out of his rights, property and currency. The cop never identified himself and does not even know the legislation under which he is acting and trying to gain authority.
He's some ignorant slob taking orders like a robot completely void of free thought and will.
The man traveling only gets aggressive after the cop attempts to violate his rights and act outside his jurisdiction thus breaking his own oath.
@JonDeth your right dude! but I still stand by the points I made, he could have went about it in a better manor and tried to educate the cop who is ignorant. and I dont agree with drink driving!
@MrJrwicked in terms of being a civil human being, the cop wins 100 fold lol.
Unfortunately this guy set out to make an example of one of them and he happened to choose one of the ignorant, decent people duped into doing corporate dirty work. He had no idea he was functioning as a revenue agent and believed he was enforcing law to protect other people.
@JonDeth RCMP - Federal - Canada wide jurisdiction.... furthermore, BC allows RCMP to Police in accordance with the provincial contract (which i'm sure you haven't read)..... Police Officer doesn't have to identify himself (BC Police Act and RCMP Act) as long as he has a uniform and name-tag and/ or regimental number. his rights are only section 10 a & b of the Charter which is to be advised the reason of arrest/ detention and right to counsel... which the Police Officer attempts to explain....
@zjk911 I'm sure it's no different than any other commonwealth where the constitution supersedes all the unlawful legislation you just mentioned. They do the same thing in the states, UK, Australia and many other countries. They pass legislation telling these buffoons they can do something that constitutional law says they can not.
Since they're trained not to understand that their oath of office to the constitution means they must abide by the constitution above all else, this happens.
a good example would be in the states, the cops are such failures at catching crime they harass people into traffic violations so they can pull us over. They start asking you questions in an attempt to get you to incriminate yourself in violation of legislation which they can act upon.
However, you have the constitutional right not to self incriminate and they have sworn an oath of office to protect that right. That constitutional right is supreme law and they can not uphold the legislation.
theguy has the right idea but u cant drive with a license plate and drivers license, once you give them this they have jurisdiction over you. because you are basically agreeing that the person on the id is you. great video tho. but im pretty ssure the guy got beat down and arrested. better luck next time
Yes even if the guy was drunk what the owner if the car was saying is true and the cop can be sued. For theft of property assault and Many other things. What I find strange us that most police are not well briefed on law ( I mean the difference between common law and commercial law ) and that police that don't understand what's going on can really open themselves to lawsuits
@maldo72 wow you are truly retarded..... theft of property isn't a criminal offence (theft is but not theft of property) and assault no because the cop said "you are under arrest" before touching this idiot...... also.... commercial law doesn't exist in the Criminal Code of Canada you should probably read that before posting stupid comments... and this member had every right to punch the guy in the face, pepper spray him and handcuff him... and section 25 of the criminal code allows it
@EasyEbookMan What information ? Because he drop a few big name doesnt mean it make sense. Lucky he didnt meet the wrong cop cause he was arrestable as soon as he refused the breath demand. That could have went really bad if he decide to resist.
@EasyEbookMan What information ? Because he drop a few big name doesnt mean it make sense. Lucky he didnt meet the wrong cop cause he was arrestable as soon as he refused the breath demand. That could have went really bad if he decided to resist.

his is a great lesson in use of your rights i not condone the attitude but i can't say i would not do the same
.
HE WAS CHARGED WITH 1. SPEEDING, 2. FAILING TO PROVIDE A BREATH SAMPLE, 3. OBSTRUCTION OF A POLICE OFFICE IN THE COURSE OF HIS DUTIES, 4. ASSAULTING A POLICE OFFICE, AND 5. RESISTING ARREST. HIS CAR WAS IMPOUNDED AND SOLD IN A POLICE AUCTION.
this cld have been a good situation to educate the officer if the guy were not drunk,. though he was right, we have to remember the officers (not talking about the heartless pigs) were duped, too. if they all wld uphold the law and know that stuff tyranny had no chance.
When you drive over 100 with alcohol on your breath you should expect to scare your neighbors. This cop was doing what he thought was right and there is no way this "freeman" was going to travel away.
Im from AZ and I will gladly lock horns with these clowns.
But please, don't give them a reason to fuck with the free people.
This is amazing. Legislation is law... right? unless they have been teaching me wrong in criminology hahaha

Well , to 'counter' your response. The Peace officer didn't officially identify himself , therefore he shouldn't do anything he says.
Lightitupp1 2 months ago
@jthompson6189 Exactly.
tyler947 1 month ago
actually in Canada, the police officer, under suspicion, can demand a sobreity test (physical or breathalyzer) which must be completed (otherwise it's a criminal offence) even before the suspect can talk to a lawyer.
sasif93 3 months ago
Goddamit this is pure Gold! It should be on every local t.v. station everywhere, make this go viral. Its good, finally the shoe's on the other foot. The police need to know their limits, they think they can abuse, intimidate and use force to get everyone to be their slaves & tax them with tickets. I'm glad he was rude, cops are scum. Where's part 2? Anyone.
If the guys drunk then there's a serious issue there, but that's aside from the common law. Morality and law are two different issues.
D33Lux 4 months ago
@D33Lux No, the law and morality are intertwined. It is through moral condemnation that an act become prohibited.
Bottom line despite all his protest he still ends up locked up. As someone has mentioned showing a licence puts him in the cops jurisdiction. everything he has said becomes evidence against him. There is a protocol to follow which goes a long way to avoid controversy and court. If I were a juror in this case I would vote to convict on this evidence alone.
MrKilroi 2 months ago
Comment removed
D33Lux 2 months ago
@MrKilroi He made that condemnation because he failed to keep his composure & with his consent he convicted himself. Morality only plays the part in the individual, people are unethical all the time. He should have keep things simple & stated his position with no further participation. Since he was obviously drunk I have no sympathy for him, but the common laws he stated I agree with. So the best thing to do is not even carry the drivers license. Its not necessary & only convicts you.
D33Lux 2 months ago
7:11 notice what the cop says on his radio... "he doesn't believe in Common Law" clear lie since the guy was claiming and acting under common law all along.

he talks about the magna carta. He is correct in the fact that the Magna Carta applies to all British commonwealth states and is written into the British North America Act of 1867 which still applies today, it's not snubbed out by the 1982 constitution, it's still a valid law today.

@WilliamTapley dont get the law here, cos its different with in a car than walking, i just past my driving test, and they want me to claim my license i dont know if i need to show ID in a car or not, or if my car has to be registered, or if it can be just "recorded" by sending in letters to head of departments in governemnt, please could you clear this up for me,, but id like to clarify what the police do with no id or license, or no licence but car is registered, or not registered with id etc
ewar9 6 months ago
@ewar9 You are not obligated to show a piece of ID while 'driving'. In fact don't even call it driving. Call it travelling.

this is a clasical case of illegal arrest.......that some (Some, not all) corrupted judges unfortunately uphold in court.

and he's really annoying, Anybody with half a brain can read about common and legislative law and play this game. What we really have here is a drunk driver with an inferiority complex and a bad attitude who thinks he's really clever because he read a few pages on wikipedia about law. If it came to light that 30mins before he was pulled over he had ran over and killed a kid everyone be calling him a villain, not a freeman. just a douch bag
beazvids 11 months ago
I agree, a lot of the world is backwoods and it is run by corporate villains who want to rob us of all our rights. This police man is a servant of that system and is paid to enforce it. If you don't respect that system or your indifferent then a policeman represents an oppressor who wants you to conform. The guy is obviously passionate about his rights and freedoms and that is commendable but you cant just drive around at any speed you want after a couple of drinks. Serve and "Protect"
beazvids 11 months ago
He also littered when throwing his cigarette. He was rude, but I do support the action taken we as citizens need to educate ourselves and defend our sovereing right. Law has way to much power especially in the states.

This guy did not play his part well. too much confrontation.
If this is real and not a fake video, then he needs a lot more education on the topics he's talking about.
I'm surprised that the cop was as well mannered as he was, considering he still thinks that Statutes are LAW

@MrJrwicked FAT LIES: There was a time when there were no Breathelizers and statistics shows that the number of road accident deaths then were lower. Its all about control buddy. Soon people will be making arguments of the kind you make her on the pat down(TSA) scanning in airports. Its got nothing to do with security.
beteck123 9 months ago
@MrJrwicked having rewatched this a number of times i agree with you comment the cop actually tries to tell this guy he's ok to leave but not with the car,ok he may have wanted it towed but if the guy was thinking straight he'd of been able to get that sorted later
the cop was sound he was a twat
got what he deserved
its called karma in some parts of the world
but he had not been in crime as far as i'm concerned
psychodrilla 11 months ago
@psychodrilla I to am a believer in karma. the point i was trying to make was that the guy in the vid could have went about things in a better manner and tried to educate the cop, who like most people are not aware of the bigger picture of what is really going on.
and the main point i was trying to make was that if he had been drinking n smoking weed aswell as speeding he could harm or kill somebody and that would be a crime.
MrJrwicked 11 months ago
@psychodrilla The cop does not have the right to seize his property without prove of a controversy
beteck123 9 months ago
@beteck123 are you stupid? section 215 of the mva (motor vehicle act) allows to impound a vehicle if the person is between .05 and .08 bac (blood alcohol content). also the vehicle is illegally parked so it has to be towed. furthermore, you are an idiot and you need to read the laws before you comment
zjk911 9 months ago
@MrJrwicked the cop is an ignorant henchman trying to extort the common man out of his rights, property and currency. The cop never identified himself and does not even know the legislation under which he is acting and trying to gain authority.
He's some ignorant slob taking orders like a robot completely void of free thought and will.
The man traveling only gets aggressive after the cop attempts to violate his rights and act outside his jurisdiction thus breaking his own oath.
JonDeth 10 months ago
@JonDeth your right dude! but I still stand by the points I made, he could have went about it in a better manor and tried to educate the cop who is ignorant. and I dont agree with drink driving!
MrJrwicked 10 months ago
@MrJrwicked in terms of being a civil human being, the cop wins 100 fold lol.
Unfortunately this guy set out to make an example of one of them and he happened to choose one of the ignorant, decent people duped into doing corporate dirty work. He had no idea he was functioning as a revenue agent and believed he was enforcing law to protect other people.
If that were the case, there would be no cars!
A vehicle of any speed is dangerous.
JonDeth 10 months ago
@JonDeth RCMP - Federal - Canada wide jurisdiction.... furthermore, BC allows RCMP to Police in accordance with the provincial contract (which i'm sure you haven't read)..... Police Officer doesn't have to identify himself (BC Police Act and RCMP Act) as long as he has a uniform and name-tag and/ or regimental number. his rights are only section 10 a & b of the Charter which is to be advised the reason of arrest/ detention and right to counsel... which the Police Officer attempts to explain....
zjk911 9 months ago
@zjk911 I'm sure it's no different than any other commonwealth where the constitution supersedes all the unlawful legislation you just mentioned. They do the same thing in the states, UK, Australia and many other countries. They pass legislation telling these buffoons they can do something that constitutional law says they can not.
Since they're trained not to understand that their oath of office to the constitution means they must abide by the constitution above all else, this happens.
JonDeth 9 months ago
a good example would be in the states, the cops are such failures at catching crime they harass people into traffic violations so they can pull us over. They start asking you questions in an attempt to get you to incriminate yourself in violation of legislation which they can act upon.
However, you have the constitutional right not to self incriminate and they have sworn an oath of office to protect that right. That constitutional right is supreme law and they can not uphold the legislation.
JonDeth 9 months ago 4
@MrJrwicked True but being pulled over and forced to comply for no reason whats so ever is also an a abuse of power.
rabbitphobia 5 months ago
theguy has the right idea but u cant drive with a license plate and drivers license, once you give them this they have jurisdiction over you. because you are basically agreeing that the person on the id is you. great video tho. but im pretty ssure the guy got beat down and arrested. better luck next time
YoungClyde420 1 year ago
Yes even if the guy was drunk what the owner if the car was saying is true and the cop can be sued. For theft of property assault and Many other things. What I find strange us that most police are not well briefed on law ( I mean the difference between common law and commercial law ) and that police that don't understand what's going on can really open themselves to lawsuits
maldo72 1 year ago
@maldo72 wow you are truly retarded..... theft of property isn't a criminal offence (theft is but not theft of property) and assault no because the cop said "you are under arrest" before touching this idiot...... also.... commercial law doesn't exist in the Criminal Code of Canada you should probably read that before posting stupid comments... and this member had every right to punch the guy in the face, pepper spray him and handcuff him... and section 25 of the criminal code allows it
zjk911 9 months ago
Minute 4:30 - 4:34
