  • Contempt of court is the only remaining common law in Canada. S9. Everything else is under the jurisdiction of the province and provincial statutes. Therefore yes you have your right to travel if you are obeying provincial statues. You are not obeying the speed limit, and the officer has reasonable grounds to give you a breath test, therefore you can't argue your common law stuff. Go to law school buddy and learn a few.

Yes you do have common law right to travel, but that law is trumped by provincial traffic laws in your province as well as the Criminal Code, both of which are created to protect members of the public's right to travel safely without intoxicated drivers risking their safety.   • @lainypink Well said, however you might want to look up the meaning of "traffic" in a legal dictionary. Traffic means commerce the highway traffic act actually applies to those engaged in commercial enterprise upon the highway. A driver is someone that is paid to do so. producing a drivers licence means you agree and are engaged in commerce upon the highway it is evidence to that effect.

  • Do you Freemen people understand that by not providing a breath sample is an offence itself, indictable even. Thus, the Peace Officer can arrest. The PO had reasonable grounds to require a breath sample, he smelled it on his breath and the driver admitted to drinking. Sorry folks, this freemen guy was just saying things to try and save his own ass, most of which made no sense. Stop blindly supporting police hate if you have 0 knowledge of law...which is very evident in these comments....

  • actually in Canada, the police officer, under suspicion, can demand a sobreity test (physical or breathalyzer) which must be completed (otherwise it's a criminal offence) even before the suspect can talk to a lawyer.

    If the guys drunk then there's a serious issue there, but that's aside from the common law. Morality and law are two different issues.

  • @D33Lux No, the law and morality are intertwined. It is through moral condemnation that an act become prohibited.

    Bottom line despite all his protest he still ends up locked up. As someone has mentioned showing a licence puts him in the cops jurisdiction. everything he has said becomes evidence against him. There is a protocol to follow which goes a long way to avoid controversy and court. If I were a juror in this case I would vote to convict on this evidence alone.

Morality only plays the part in the individual, people are unethical all the time. He should have keep things simple & stated his position with no further participation. Since he was obviously drunk I have no sympathy for him, but the common laws he stated I agree with. So the best thing to do is not even carry the drivers license. Its not necessary & only convicts you.

  • @JonDeth RCMP - Federal - Canada wide jurisdiction.... furthermore, BC allows RCMP to Police in accordance with the provincial contract (which i'm sure you haven't read)..... Police Officer doesn't have to identify himself (BC Police Act and RCMP Act) as long as he has a uniform and name-tag and/ or regimental number. his rights are only section 10 a & b of the Charter which is to be advised the reason of arrest/ detention and right to counsel... which the Police Officer attempts to explain....

They do the same thing in the states, UK, Australia and many other countries. They pass legislation telling these buffoons they can do something that constitutional law says they can not.

  • a good example would be in the states, the cops are such failures at catching crime they harass people into traffic violations so they can pull us over. They start asking you questions in an attempt to get you to incriminate yourself in violation of legislation which they can act upon.

    However, you have the constitutional right not to self incriminate and they have sworn an oath of office to protect that right. That constitutional right is supreme law and they can not uphold the legislation.
